Resumen
El informe jurídico en el que el lector está apunto de adentrarse busca analizar
la Casación N˚1583-2018-Cusco, emitida por la Sala Civil Permanente de la
Corte Suprema. El contexto de esta sentencia casatoria tiene lugar en el proceso
de nulidad de acto jurídico incoado por Doris Becerra Lira contra Jesús Romero
Arias y los esposos Lorenzo Condori Flores y Asencia Chara Hancco, por el cual
se pretende, principalmente, la declaración de nulidad del contrato de
compraventa celebrado entre los demandados. En dicho proceso se debate si
los esposos deben ser considerados terceros de buena fe registral.
Dicho lo anterior, el problema principal propuesto es determinar si los esposos
Lorenzo Condori Flores y Asencia Chara Ancco deben ser protegidos por el
principio de buena fe registral regulado en el artículo 2014 del Código Civil, antes
de su modificatoria. A tal fin, nos apoyaremos en nuestra doctrina nacional y
jurisprudencia. Además, dado que este trabajo busca el protagonismo del
derecho procesal, abordaremos el análisis de la prueba de oficio, así como la
motivación probatoria, siendo pertienentes los artículos 194 y 197 del Código
Procesal Civil, e incluiremos algunas de las reglas del X Pleno Casatorio Civil.
Por último, nos gustaría adelantar al lector que la conclusión a la que arribamos
es que los esposos sí debieron ser protegidos por el principio de buena fe
registral, pues la evaluación que se hizo del mismo comprendió la aplicación
arbitraria de ciertas normas procesales, lo cual coadyuva a que se llegará a una
conclusión errónea.
The legal report in which the reader is about to enter seeks to analyze Cassation N˚1583-2018-Cusco, issued by the Permanent Civil Chamber of the Supreme Court. The context of this cassation judgment takes place in the process of nullity of legal act filed by Doris Becerra Lira against Jesús Romero Arias and the spouses Lorenzo Condori Flores and Asencia Chara Hancco, by which it is sought, mainly, the declaration of nullity of the purchase and sale contract entered into between the defendants. In said proceeding it is debated whether the spouses should be considered third parties of good faith in the registry. Having said the above, the main problem proposed is to determine whether the spouses Lorenzo Condori Flores and Asencia Chara Ancco should be protected by the principle of good faith in the registry regulated in article 2014 of the Civil Code, before its amendment. To this end, we will rely on our national doctrine and jurisprudence. In addition, since this work seeks the protagonism of procedural law, we will address the analysis of ex officio evidence, as well as the evidentiary motivation, being pertient articles 194 and 197 of the Civil Procedural Code, and we will include some of the rules of the X Plenary Civil Cassation. Finally, we would like to advance to the reader that the conclusion we reach is that the spouses should have been protected by the principle of good faith in the registry, since the evaluation made of the same included the arbitrary application of certain procedural rules, which contributes to reach an erroneous conclusion.
