Resumen
El presente informe jurídico contiene un análisis de la aplicación del principio de
confianza en el procesamiento del delito de la negociación incompatible, a partir de los
problemas jurídicos identificados en la Casación N°1833-2019/LIMA, emitida por la Sala
Penal Permanente de la Corte Suprema de Justicia de la República. El recurso de
casación declarado fundado, que se resuelve en la citada sentencia, fue interpuesto por
la Fiscal Superior, quien denuncia como motivo la violación de la garantía de la
motivación, pues cuestiona que la aplicación del principio de confianza en el delito de
negociación incompatible no sea la misma para los acusados; además, la Fiscal solicita
que se defina si la infracción de deber y el principio de confianza pueden ser aplicados
a un funcionario que infringió deberes específicos que se le fueron conferidos.
Entre los objetivos de este informe se encuentra el establecer los límites del principio de
confianza frente al argumento de defensa en el procesamiento por el delito de
negociación incompatible, así como analizar el principio de confianza como parte de la
imputación objetiva, y la intervención de sujetos en la comisión del delito de negociación
incompatible. Al respecto, este informe jurídico postula que, no se puede desconocer el
principio de confianza, pero su aplicación no es absoluta, y sus límites deben ser
analizados cuando sea utilizado como argumento exculpante en delitos de negociación
incompatible.
This legal report presents an analysis of the application of the principle of trust in the prosecution of the crime of incompatible negotiation. The analysis is based on the legal issues identified in Cassation No. 1833-2019/LIMA, issued by the Permanent Criminal Chamber of the Supreme Court of Justice of the Republic. The appeal, which was filed by the Superior Prosecutor and declared well-founded in the aforementioned sentence, raises concerns about the violation of the guarantee of motivation. The Superior Prosecutor questions the consistency of applying the principle of trust in the crime of incompatible negotiation among the defendants. Additionally, the Prosecutor requests clarification on whether the breach of duty and the principle of trust can be applied to an official who has violated specific duties conferred upon them. The objectives of this report include establishing the limits of the principle of trust in response to the defense argument in the prosecution of the crime of incompatible negotiation. The report also aims to analyze the principle of trust within the framework of objective imputation and the involvement of individuals in the commission of the crime. In this context, the legal report asserts that while the principle of trust cannot be disregarded, its application is not absolute, and its limitations must be examined when used as an exculpatory argument in cases of incompatible negotiation.
