Abstract
El presente informe aborda el análisis de la Sentencia de Casación N°5990-
2023- SELVA CENTRAL, la cual versa sobre el despido disciplinario del Sr.
Galindo, trabajador minero, por encontrarse libando alcohol dentro de su
dormitorio que se situaba en el campamento minero, a horas de la madrugada,
es decir, fuera de su horario de trabajo. Ante ello, se le imputó el literal e) del
artículo 25 del Texto Único ordenado de la Ley de Productividad y Competitividad
Laboral.
Al respecto, se analizará si el despido fue proporcional y razonable, en donde se
considerará si los dormitorios de la Unidad Minera deben ser considerados como
centros de trabajo, si la potestad fiscalizadora del empleador puede traspasar los
límites de la intimidad, y si el solo resultado positivo de un dosaje etílico es
considerado absoluto para la imputación del despido.
Con ello, concluimos que no puede existir una configuración del inciso e) del
artículo 25 dentro de los espacios de descanso y fuera del horario laboral, más
aún cuando estamos frente a regímenes especiales laborales. Siendo necesario,
también, delimitar el poder de fiscalización del empleador y el marco
constitucional de las medidas disciplinarias. Por lo tanto, en discordancia con la
Corte Suprema, no se debió avalar el despido disciplinario.
This report deals with the analysis of the Cassation Judgment N°5990-2023- SELVA CENTRAL, which deals with the disciplinary dismissal of Mr. Galindo, a mining worker, for being found libelling alcohol inside his dorm room at the mining camp in the early hours of the morning, that is, outside his working hours. Against this background, he was charged with the letter e) of article 25 of the Single Ordered Text of the Labor Productivity and Competitiveness Law. In this regard, it will be analyzed whether the dismissal was proportional and reasonable, where it will be considered if the dormitories of the Mining Unit should be considered as work centers, if the supervisory power of the employer can go beyond the limits of privacy, and if the only positive result of an ethyl dosage is considered absolute for the imputation of dismissal. Thus, we conclude that there can be no configuration of article 25 e) within the rest areas and outside working hours, even more so when we are dealing with special employment arrangements. It is also necessary to delimit the employer’s power of control and the constitutional framework for disciplinary measures. Therefore, in disagreement with the Supreme Court, the disciplinary dismissal should not have been shaken.
