Resumen
En el presente informe jurídico se tiene como objetivo analizar de manera
concreta el análisis de la Sala respecto de la Resolución Nº 2272-
2018/SPC/INDECOPI, la cual consiste en una denuncia por parte de la señora
Agostini contra el Banco Falabella por seis (6) operaciones no reconocidas,
puntualmente disposiciones de efectivo hechas en cajeros automáticos. Por
ello, se analizará si la entidad bancaria cumplió con acreditar la ideoneidad de
sus medidas de seguridad como la acreditación de las operaciones y el análisis
de patrón habitual de consumo. Seguidamente, también se analizará lo
alegado por la denunciante respecto a un supuesto caso de clonación de su
tarjeta de crédito, con la que pudieron efectuar las operaciones. Finalmente, se
evaluará si la decisión de la Sala en devolver solo cuatro (4) operaciones de las
seis (6) reclamadas fue lo correcto
The purpose of this legal report is to specifically analyze the Chamber's analysis regarding Resolution No. 2272-2018/SPC/INDECOPI, which consists of a complaint by Mrs. Agostini against Banco Falabella for six (6) unrecognized operations, occasionally cash withdrawals made at ATMs. For this reason, it will be analyzed whether the bank complied with accrediting the suitability of its security measures such as the accreditation of operations and the analysis of the habitual pattern of consumption. Next, the allegations made by the complainant regarding an alleged case of cloning her credit card, with which they were able to carry out the operations, will also be analyzed. Finally, it will be evaluated whether the Chamber's decision to return only four (4) operations out of the six (6) claimed was correct
