Resumen
Para participar en el mercado, los agentes económicos adoptan distintas estrategias y
formas de organizarse con la finalidad de que su oferta resalte por encima de la de sus
competidores. Ello incluye, por su puesto, el tipo de modelo de negocio. En el mercado
de los cines esto no funciona diferente. No obstante, hace unos pocos años, INDECOPI,
a través de la Sala Especializada en Protección al Consumidor emitió la Resolución N.º
243-2018/SPC-INDECOPI, a través de la cual sancionó con una amonestación a
Cinemark por infringir el artículo 50 literal e) del Código de Protección y Defensa del
Consumidor al establecer que los consumidores que hayan adquirido un boleto para
asistir a la función de una película en sus instalaciones puedan ingresar a las salas de
cine con alimentos que no hayan sido adquiridos en su área de confitería.
Es por ello por lo que, en el presente trabajo, no solo analizaremos la discusión
sustantiva sobre la comisión de la infracción antes mencionada, estableciendo como
cuestión previa el rol del INDECOPI como protector de los consumidores y del adecuado
desarrollo del proceso competitivo; sino que, además, discutiremos sobre aspectos
formales propios del procedimiento administrativo sancionador relativos a la imputación
realizada durante el inicio y la sanción y medida correctiva impuestas hacia el final.
Para tal fin, hemos realizado un estudio de fuentes doctrinarias y legislativas, así como
pronunciamientos de la Administración Pública y jurisprudencia del Tribunal
Constitucional.
To participate in the market, economic agents adopt different strategies and forms of organization to make their offer stand out from those of their competitors. This includes, of course, the type of business model. This is also true in the film industry. However, a few years ago, INDECOPI, through the Specialized Chamber for Consumer Protection, issued Resolution No. 243-2018/SPC-INDECOPI, whereby it sanctioned Cinemark with a reprimand for infringing Article 50, Literal e), of the Code of Consumer Protection and Defense by establishing that consumers who have purchased a ticket to attend the screening of a movie in its facilities may enter the movie theaters with food that has not been purchased in its confectionery area. That is why, in this legal report, we will not only analyze the substantive discussion on the commission of the infringement, establishing as a prior question the role of INDECOPI as a protector of consumers and the proper development of the competitive process, but we will also discuss formal aspects of the administrative sanctioning procedure regarding the imputation made at the beginning and the sanction and corrective measure imposed towards the end. For this purpose, we have made a study of doctrinal and legislative sources, as well as pronouncements of the public administration and the jurisprudence of the Constitutional Tribunal.
