Abstract
El presente informe jurídico versa sobre la Resolución N°1131-2019 expedida por
Indecopi, en donde la empresa Los Portales SAC, decide allanarse, en primera
instancia a la denuncia presentada por la denunciante, la señora Pérez Palomino; sin
embargo, posterior a recibir los beneficios otorgados por la figura del allanamiento
decide apelar la Resolución en todos sus extremos. En ese sentido, el presente
trabajo analiza si el recurso de apelación es compatible, en este caso, con la figura
del allanamiento; concluyendo que debe ser considerado como una circunstancia
agravante, ello en base a la conducta del demandado en el proceso. Asimismo, se
analiza cuál es la naturaleza del procedimiento de protección al consumidor,
examinando cuáles son las características de la naturaleza sancionadora y trilateral,
para determinar que es de naturaleza mixta; además, a fin de verificar si en el
presente caso, las medidas correctivas impuestas por el órgano administrativo
producen un agravio al infractor, se analizan teniendo en consideración si cumplen o
no con lo establecido en el principio de razonabilidad.
This legal report addresses Resolution No. 1131-2019 issued by Indecopi, in which the company Los Portales S.A.C. decided to submit to the complaint filed by the claimant, Ms. Pérez Palomino, in the first instance. However, after receiving the benefits granted by the admission of liability (allanamiento), the company subsequently decided to appeal the Resolution in its entirety. In this regard, the present work analyzes whether the appeal is compatible, in this case, with the figure of admission of liability, concluding that it should be considered an aggravating circumstance, based on the conduct of the defendant during the proceedings.Likewise, the nature of the consumer protection procedure is examined, analyzing the characteristics of its sanctioning and trilateral nature, to determine that it is of a mixed nature. Furthermore, in order to verify whether, in the present case, the corrective measures imposed by the administrative body constitute a grievance to the infringer, these measures are assessed in light of their compliance with the principle of proportionality.
