Abstract
La Resolución N° 124-2020/CCD-INDECOPI es un paso clave en la regulación
de la publicidad digital, especialmente en lo que respecta al rol de los influencers.
Este informe analiza la sanción que se le aplicó al influencer Andy Merino
Ramírez por promocionar la aplicación Picap a través de sus redes sociales, lo
que se consideró un acto de competencia desleal. En la resolución se discute si
los influencers deberían ser considerados como medios de comunicación social
o agencias de publicidad, y si sus acciones pueden ser sancionadas bajo la Ley
de Represión de la Competencia Desleal (DL N° 1044).
Este caso resalta la creciente influencia que tienen los influencers en la era
digital, donde la publicidad se distribuye rápidamente y, en muchas ocasiones,
de manera disimulada. El uso del hashtag "#ad" no fue suficiente para garantizar
la transparencia de la publicidad, lo que plantea dudas sobre la adecuación de
las normativas actuales. Además, se observa que los influencers tienen una
responsabilidad directa en la promoción de productos y servicios, especialmente
cuando estas acciones inducen a los consumidores a realizar actos ilegales,
como en el caso de Picap, que operaba de manera ilegal en el mercado de
transporte.
Resolution N° 124-2020/CCD-INDECOPI is a key step in regulating digital advertising, especially regarding the role of influencers. This report analyzes the sanction imposed on influencer Andy Merino Ramírez for promoting the Picap app through his social media, which was considered an act of unfair competition. The resolution discusses whether influencers should be considered as media outlets or advertising agencies, and whether their actions can be sanctioned under the Law on the Suppression of Unfair Competition (DL No. 1044). This case highlights the growing influence of influencers in the digital age, where advertising spreads quickly and often in a disguised manner. The use of the "#ad" hashtag was not enough to ensure advertising transparency, raising concerns about the adequacy of current regulations. Additionally, it is observed that influencers have a direct responsibility in promoting products and services, especially when these actions lead consumers to engage in illegal activities, as seen in the case of Picap, which was operating illegally in the transportation market.
