La sentencia interlocutoria denegatoria como barrera al acceso a la jurisdicción constitucional

Abstract

Los altos tribunales como parte de su política jurisdiccional, emplean mecanismos normativos, jurisprudenciales y administrativos a fin de gestionar de manera adecuada su carga procesal y elevar su productividad. Sin embargo, dichas medidas no pueden establecerse en menoscabo del cumplimiento de sus funciones, más aun cuando dicha función es la de tutelar en última instancia derechos fundamentales. Por lo que cobra especial relevancia el análisis del impacto del precedente Vásquez Romero en la producción jurisdiccional y la fundabilidad de sus resoluciones al ser un aspecto no explorado por las investigaciones precedentes, las cuales se han remitido a un análisis dogmático y normativo del mismo. En el trascurso de la presente investigación hemos llegado a la conclusión que el precedente Vásquez Romero, es formal y materialmente inconstitucional al violar los parámetros propios del principio de autonomía procesal, y jerarquía normativa; mientras que como mecanismo de descarga procesal, se ha determinado que no ha cumplido con incrementar significativamente el índice neto de productividad del Tribunal Constitucional, reduciéndose hasta en un tercio el porcentaje promedio de sentencias fundadas emitidas antes de su vigencia.The high courts, as part of their jurisdictional policy, use normative, jurisprudential and administrative mechanisms in order to adequately manage their procedural burden and raise their productivity. However, these measures can not be established to the detriment of the fulfillment of their functions, especially when this function is to ultimately protect fundamental rights. Therefore, the analysis of the impact of the previous Vásquez Romero on jurisdictional production and the foundability of its resolutions is relevant because it is an aspect not explored by previous investigations, which have been referred to a dogmatic and normative analysis of it. In the course of this investigation we have come to the conclusion that the precedent Vásquez Romero, is formally and materially unconstitutional by violating the parameters of the principle of procedural autonomy, and normative hierarchy; while as a procedural unloading mechanism, it has been determined that it has not complied with significantly increasing the net productivity rate of the Constitutional Court, reducing the average percentage of well-founded judgments issued before its validity by up to one third.
