Resumen
El presente informe jurídico analiza la Resolución N.° 12 del expediente N.° 00313-
2016-0-1817-SP-CO-01 de fecha 01 de marzo de 2017, emitida por la Primera Sala
Comercial de la Corte Superior de Justicia de Lima, que declaró fundado el recurso de
anulación. Dicha decisión, se sustentó en la causal contenida en el literal c) del inciso
1 del artículo 63 de la Ley de Arbitraje, al estimar que el laudo arbitral, fue expedido sin
la presencia de un tribunal arbitral imparcial, lo que generó el incumplimiento de una
correcta composición arbitral y; en consecuentancia, afectó el derecho al debido
proceso.
La anulación del laudo se fundamenta en supuestas vulneraciones al deber de
independencia y al deber de imparcialidad del árbitro Juan Huamaní Chavez, así como
al derecho de defensa y debida motivación del laudo, y a la extralimitación del tribunal
arbitral por incurrir en incongruencia extra petita.
El presente informe sostiene que la resolución judicial que anula el laudo carece de
sustento jurídico válido, y para ello desarrolla el análisis de temas referentes a la
anulación de laudos arbitrales, el deber de revelación, el deber de independencia e
imparcialidad de los árbitros, el derecho de defensa y la debida motivación de los laudos,
así como la incongruencia procesal extra petita.
This legal report analyzes Resolution No. 12 of file No. 00313-2016-0-1817-SP-CO-01 dated March 01, 2017, issued by the First Commercial Chamber of the Superior Court of Justice of Lima, which declared the annulment appeal well-founded. Said decision was based on the grounds contained in paragraph c) of subsection 1 of Article 63 of the Arbitration Law, considering that the arbitral award was issued without the presence of an impartial arbitral tribunal, which generated the breach of a correct arbitral composition and consequently affected the right to due process. The annulment of the award is based on alleged violations to the duty of independence and the duty of impartiality of the arbitrator Juan Huamaní Chavez, as well as to the right of defense and due motivation of the award, and the overreaching of the arbitral tribunal by incurring in extra petita inconsistency. This report argues that the judicial resolution that annuls the award lacks valid legal grounds, and for this purpose it develops the analysis of issues related to the annulment of arbitral awards, the duty of disclosure, the duty of independence and impartiality of the arbitrators, the right of defense and the due motivation of the awards, as well as the procedural inconsistency extra petita.
