Las posibilidades y limitaciones de la maternidad subrogada: un estudio desde la experiencia peruana

Abstract

La presente tesis examina la maternidad subrogada en el Perú desde un enfoque bioético-jurídico, analizando las implicancias de su falta de regulación específica en un contexto donde su práctica se incrementa progresivamente sin un ordenamiento jurídico claro. A partir del análisis normativo internacional y nacional, se propone un marco teórico basado en la bioética de mínimos y principios fundamentales como la autonomía relacional, beneficencia, no maleficencia y justicia (incorporando nociones de vulnerabilidad e interseccionalidad). Ello permite evaluar la maternidad subrogada considerando su complejidad inherente y las particularidades del contexto peruano, donde factores sociales, económicos y culturales determinan significativamente las condiciones en que se desarrolla esta práctica. Además, se aborda la referida prohibición implícita en la Ley General de Salud mediante una interpretación constitucional, identificando cinco desafíos clave. Finalmente, como aporte central, se presentan lineamientos bioético-jurídicos que orientan un tratamiento adecuado de la gestación por sustitución. De esta manera, se armonizan los derechos de todas las partes involucradas, en especial los de la mujer gestante y del concebido, contribuyendo así al debate constitucional e interdisciplinario sobre esta práctica en el Perú.

This thesis examines surrogacy in Peru from a bioethical and legal perspective, analyzing the implications of its lack of specific regulation in a context where the practice is progressively increasing without a clear legal framework. Based on a review of international and national regulations, it proposes a theoretical framework grounded in minimal bioethics and fundamental principles such as relational autonomy, beneficence, non-maleficence, and justice—incorporating notions of vulnerability and intersectionality. This approach allows for an evaluation of surrogacy that accounts for its inherent complexity and the particularities of the Peruvian context, where social, economic and cultural factors significantly shape the conditions under which the practice occurs. Additionally, the thesis addresses the implicit prohibition found in the General Health Law through a constitutional interpretation, identifying five key challenges. Finally, as its central contribution, it presents bioethical and legal guidelines for the proper regulation of surrogacy, aiming to harmonize the rights of all parties involved—particularly those of the gestational mother and the unborn child— thus contributing to the constitutional and interdisciplinary debate on this issue in Peru.
