Aplicación de la representación sucesoria en el derecho peruano: dificultades y complicaciones

Abstract

The representation under the Law of Succession originated with the purpose of protecting a lineage of descendants whose ascendant was entitled to inherit, but did not do so. This representative and important figure of the Law of Succession has faced numerous problems and complications. In this respect, this article will define the concept of inheritance, its requirements and legal nature, as well as its limitations and its jurisprudential development.La representación sucesoria se originó con el objetivo de amparar a una estirpe de descendientes a cuyo ascendiente le correspondía heredar, pero no lo hizo. Esta figura tan representativa e importante del Derecho de Sucesiones se ha enfrentado a numerosos problemas y complicaciones.En esa línea, el presente artículo definirá el concepto de sucesiones, sus requisitos y naturaleza jurídica, así como sus limitaciones y su desarrollo jurisprudencial.
