Feminismo jurídico, Derecho Internacional de los Derechos Humanos (DIDH) y política migratoria: vínculos para la garantía y protección de los derechos de las mujeres migrantes

Abstract
Esta tesis busca dar respuesta a la pregunta sobre si los estándares desarrollados
desde el Derecho Internacional de los Derechos Humanos (DIDH) en materia de
movilidad humana presentan vacíos y contradicciones para garantizar la protección de
los derechos de las mujeres migrantes; o si, por el contrario, resultan suficientes para
este fin. Nuestra hipótesis parte de reconocer que el desarrollo del DIDH en materia de
movilidad humana ha permitido establecer estándares necesarios de protección y
garantía de derechos en el caso de personas migrantes; sin embargo, aplicando una
perspectiva feminista de análisis jurídico, al igual que lo que ocurre en otras ramas del
Derecho, es posible que estos estándares presenten vacíos, inconsistencias o
contradicciones que deriven en mantener o reforzar relaciones de opresión por motivos
de género en perjuicio de las mujeres migrantes.
A partir de ello, nos trazamos como objetivo identificar los posibles vacíos y
contradicciones existentes en los estándares desarrollados en el DIDH en torno a la
protección y garantía de los drechos de las mujeres migrantes. Para alcanzar ese fin
general, nos planteamos los siguientes objetivos específicos: (i) conocer las principales
críticas feministas al Derecho y, en particular al Derecho Internacional de los Derechos
Humanos; (ii) caracterizar los principales estándares desarrollados desde el DIDH sobre
principio de no discrminación y no devolución; (iii) identificar los principales vacíos y
contradicciones, desde una perspectiva feminista, en los estándares caracterizados; (iv)
abordar la relación entre el DIDH y las políticas migratorias, observando la manera en
que estas últimas incorporan los estándares identificados; y, (v) identificar los principales
vacíos y contradicciones de las políticas migratorias en relación a la protección de los
derechos de las mujeres.
La metodología se compone de un análisis dogmático que parte de un enfoque crítico
jurídico feminista con una orientación hacia los estudios migratorios. En esa línea, se
emplearon diversas técnicas de investigación como revisión documental, bibliográfica y
jurisprudencial; análisis normativo y de políticas públicas; y análisis de género.
Concluimos que desde una perspectiva crítica feminista, efectivamente, existen vacíos
e inconsistencias en los estándares desarrollados en el DIDH en torno a los principios
de no discriminación y no devolución; y que estos vacíos repercuten en la protección
garantizada a mujeres migrantes a través de las políticas migratorias, como sucede en
el caso peruano.
