Prescripción y caducidad : la extinción de acciones y derechos en el Código civil
Abstract
El autor se interesó por el tema en razón a que siempre encontró confuso el problema de la prescripción o la caducidad en las acciones, y al efectuar la revisión confirmó esta apreciación: el Código no hace mención expresa a cuál de las dos instituciones es aplicable en multitud de artículos. Tampoco señala muchas veces los términos iniciales para contarlas y finalmente, considera que a veces habla de caducidad cuando debe decir prescripción, y viceversa. Este libro tiene dos partes. En la primera se aborda el análisis de los conceptos y las normas positivas sobre la prescripción extintiva y sobre la caducidad. En la segunda, se hace una revisión exhaustiva de todos los dispositivos en los cuales se habla expresamente de acción, y tiene como objetivo fundamental ver su consistencia con las normas del libro VIII del Código Civil.
