Protocolo de intervención policial para ejecutar la defensa posesoria extrajudicial de inmuebles particulares en el distrito de Carabayllo desde el año 2018 al 2021

Resumen
El presente estudio se desarrolló en el distrito de Carabayllo donde existen
cuatro entidades policiales, las mismas que son: Comisaria PNP de Carabayllo, Santa
Isabel y Progreso y el Departamento de Investigación Criminal de Carabayllo. Según la
División de Estadística de la Policía Nacional del Perú el distrito de Carabayllo ha
registrado denuncias por delito de usurpación según el siguiente detalle: año 2018: 98
denuncias, año 2019: 31 denuncias, año 2020: 17 denuncias, año 2021: 120 denuncias
y el año 2022: 184 denuncias. Cabe señalar que las denuncias por usurpación en el año
2020 y en el año 2021 ocuparon el primer lugar en la incidencia delictiva en el
Departamento de Investigación Criminal del distrito en mención. Asimismo, el distrito de
Carabayllo registra 477 denuncias por usurpación ocupando el primer lugar entre los 43
distritos analizados de Lima Metropolitana durante los años 2018 a abril 2023, muy por
encima del promedio que es de 86 denuncias por distrito de Lima Metropolitana; hecho
que demuestra que la usurpación es un problema público grave que afecta el desarrollo
socioeconómico del distrito Carabayllo. Por lo que, se centró en estudiar el problema
público referido a la deficiente intervención policial en la defensa posesoria extrajudicial
de inmuebles particulares para combatir las usurpaciones de predios dentro de
Carabayllo, desde los años 2018 al 2021. Las causas del problema público se orientaron
en deficiente interpretación de la norma por parte de los comisarios de la PNP, Falta de
herramientas técnico – legales institucionales que permitan al personal PNP cumplir con
eficacia el apoyo policial en la defensa posesoria extrajudicial y Falta de difusión de la
norma dentro de la PNP, entre otras. La investigación se desarrolló con la metodología
de Investigación Aplicada, diseño no experimental y nivel descriptiva. Para la
recolección de la data se estudió el mapa de la jurisdicción policial, se realizó una
exhaustiva revisión documental y se aplicaron entrevistas. Lo que originó un protocolo
de intervención policial que permite el establecimiento de un procedimiento operativo a
seguir por la PNP en casos donde los ciudadanos presenten solicitudes de defensa
posesoria extrajudicial de posesiones inmuebles o predios de propiedad particular.
This study was carried out in the district of Carabayllo where there are four police entities, they are: PNP Commissioner of Carabayllo, Santa Isabel and Progreso and the Criminal Investigation Department of Carabayllo. According to the Statistics Division of the National Police of Peru, the district of Carabayllo has registered complaints for the crime of usurpation according to the following detail: Year 2018: 98 complaints, Year 2019: 31 complaints, Year 2020: 17 complaints, Year 2021: 120 complaints and Year 2022: 184 Complaints. It should be noted that complaints of usurpation in 2020 and 2021 ranked first in the criminal incidence in the Criminal Investigation Department of Carabayllo. Likewise, the district of Carabayllo registers 477 complaints of usurpation, occupying the first place among the 43 districts analyzed of Metropolitan Lima during the years 2018 to April 2023, well above the average of 86 complaints per district of Metropolitan Lima; a fact that shows that usurpation is a serious public problem that affects the socioeconomic development of the Carabayllo district. Therefore, it focused on studying the public problem referred to the deficient police intervention in the extrajudicial possessory defense of private properties to combat the usurpations of properties within Carabayllo, from 2018 to 2021. The causes of the public problem were oriented in deficient interpretation of the norm by the commissioners of the PNP, Lack of technical-legal institutional tools that allow PNP personnel to effectively fulfill the police support in the extrajudicial possessory defense and Lack of dissemination of the norm within the PNP, among others. The research was developed with the methodology of Applied Research, non-experimental design and descriptive level. For data collection, the map of police jurisdiction was studied, an exhaustive documentary review was carried out and interviews were applied. This led to a police intervention protocol that allows the establishment of an operating procedure to be followed by the PNP in cases where citizens submit requests for extrajudicial possessory defense of real estate or privately owned properties.
