En búsqueda de una regulación: apuntes sobre los alcances subjetivos de la cosa juzgada en procesos colectivos

Abstract

El trabajo analiza los diversos sistemas existentes sobre los alcances subjetivos de la sentencia emitida en un proceso colectivo, mostrando su preferencia por la teoría pro et contra con la opción de opt out para los efectos de la cosa juzgada. Igualmente, se sostiene que la teoría de la carga de la prueba dinámica puede representar una solución al hecho que los demandantes del grupo colectivo puedan verse afectados por una mala estrategia procesal en el primer proceso donde se obtuvo una sentencia desfavorable.The paper analyzes the various existing systems on the subjective scope of the sentence issued in a collective process, showing their preference for the pro et contra with the option of opt out for the effects of the res judicata. Likewise, it is argued that the theory of the burden dynamic of the proof may represent a solution to the fact that the plaintiffs of the collective group may be affected by a poor procedural strategy in the first process where an unfavorable judgment was obtained.
