Fortalecimiento de la capacidad estatal de la Policía Nacional del Perú para interceptar en tiempo real las comunicaciones por internet

Abstract
El objetivo principal de la presente investigación es describir las brechas tecnológicas en
la lucha contra la criminalidad organizada, respecto a la falta de capacidad de la Policía
Nacional del Perú para interceptar en tiempo real las comunicaciones por internet en el
año 2018 al 2020, identificando y analizando las causas que limitan a las instituciones
persecutoras del delito poder controlar la criminalidad durante la intervención de las
comunicaciones.
Los avances de la tecnología han abierto muchas ventanas de oportunidad y estas a su
vez han sido aprovechadas por elementos antisociales, quienes por su libre albedrío
organizan, planean, dirigen, ejecutan y controlan sus actividades criminales por medio o
utilizando dispositivos electrónicos teniendo como medio el internet, los cuales en un
eventual proceso de investigación penal, dichas interacciones en sus comunicaciones de
los elementos criminales no puede ser conocido por la autoridad persecutora del delito,
debido a la falta de capacidad estatal de la institución policial, toda vez que realizan
comunicaciones por medio de aplicativos móviles y actualmente estas no pueden ser
interceptadas en tiempo real por el Departamento de Apoyo Técnico Judicial de la
Dirección Antidrogas (DEPATEJUD) de la Policía Nacional del Perú (PNP)
“Constelación”, trayendo imputaciones penales débiles que posteriormente generan
impunidad.
El presente trabajo de investigación, propone la implementación del Programa
“SERPICO”, que consiste en diseñar y formular un instrumento legal que siente las bases
en el Código Procesal Penal y a partir de ello, en un siguiente componente desarrolla el
sendero para la gestión de la creación, implementación y articulación de la Unidad
Funcional de Registros Remotos de la PNP, quien sería el órgano estatal responsable de
la interceptación de las comunicaciones por internet.
The main objective of this research is to describe the technological gaps in the fight against organized crime, regarding the lack of capacity of the National Police of Peru to intercept in real time Internet communications in the year 2018 to 2020, identifying and analyzing the causes that limit the institutions that persecute the crime to be able to control crime during the intervention of communications. Advances in technology have opened many windows of opportunity and these, in turn, have been taken advantage of by antisocial elements, who by their free will organize, plan, direct, execute and control their criminal activities through or using electronic devices using the internet, which in a possible criminal investigation process, said interactions in their communications of the criminal elements cannot be known by the authority prosecuting the crime, due to the lack of state capacity of the police institution, since they carry out communications by through mobile applications and currently these cannot be intercepted in real time by the Judicial Technical Support Department of the Anti-Drug Directorate of the National Police of Peru "Constellation", bringing weak criminal charges that subsequently generate impunity. The present research work proposes the implementation of the "SERPICO" Program, which consists of designing and formulating a legal instrument that lays the foundations in the Criminal Procedure Code and from this, in a following component, develops the path for the management of the creation, implementation and articulation of the Remote Records Unit of the Peruvian National Police, which would be the state body responsible for the interception of Internet communications.
