¿Quién tiene el control?: los derechos de las personas LGBTIQ+ en Perú

Abstract

El presente trabajo aborda la aplicación de los estándares interamericanos de protección de los derechos de las personas LGBTIQ+ por Perú a través del control de convencionalidad. En ese sentido, nos centraremos en sus dos manifestaciones ("erga omnes" e "inter partes") con base en el análisis de los avances normativos y las sentencias desarrolladas por el Tribunal Constitucional en materia de identidad de género y matrimonio igualitario; así como, aquellas sentencias en las que Perú es parte material del proceso respecto a casos de violencia contra personas LGBTIQ+ ante la Corte Interamericana de Derechos Humanos.The present paper addresses the application of inter-American standards for the protection of the rights of LGBTIQ+ persons by Peru through conventional control. In this regard, we will focus on its two manifestations ("erga omnes" and "inter partes") based on the analysis of the normative advances and the judgments developed by the Constitutional Court on gender identity and equal marriage; as well as those judgments in which Peru is a material part of the process regarding cases of violence against LGBTIQ+ persons before the Inter- American Court of Human Rights.
