Resumen
El presente informe jurídico posee como objetivo analizar de manera concreta el
criterio de patrón de consumo, en base a la Resolución Nº 2272-
2018/SPC/INDECOPI, la cual consiste en la denuncia interpuesta por parte de la
señora Agostini en contra el Banco Falabella a raíz de seis (6) operaciones no
reconocidas efectuadas en su producto financiero. Por ello, se revisará y
analizará el marco normativo financiero respecto a operaciones no reconocidas
y el patrón de consumo, tanto en Perú como en países de la región, así como
ver sus respectivas estadísticas. Seguidamente, se hará una comparativa con el
perfilamiento de clientes en la colocación de créditos. Por último, se brindará una
propuesta de solución para establecer un criterio único en los lineamientos a fin
de uniformizar las resoluciones.
The objective of this legal report is to specifically analyze the consumption pattern criterion, based on Resolution No. 2272-2018/SPC/INDECOPI, which consists of the complaint filed by Mrs. Agostini against Banco Falabella. following six (6) unrecognized operations carried out in its financial product. For this reason, the financial regulatory framework will be reviewed and analyzed regarding unrecognized operations and the consumption pattern, both in Peru and in countries in the region, as well as viewing its statistics. Next, a comparison will be made with the profiling of clients in the placement of credits. Finally, a proposed solution will be provided to establish a single criterion in the guidelines in order to standardize the resolutions.
