La regulación de los accidentes in itinere en la legislación laboral peruana: alcances y propuesta de reforma

Resumen
En la presente investigación se analizarán los alcances y límites de la protección otorgada
por la normativa laboral frente a los accidentes ocurridos en el trayecto al centro de labores.
El análisis se ha realizado tomando como punto de partida la distinción entre la normativa de
seguridad y salud en el trabajo, que tiene por finalidad la prevención de los riesgos; y, la
normativa que otorga cobertura a los trabajadores frente a siniestros laborales, esto es, el
sistema de aseguramiento del Seguro Complementario de Trabajo de Riesgo. Posteriormente,
se realiza un estudio de las definiciones de accidente in itinere a partir de su reconocimiento
en la legislación comparada, para después contrastar la misma con la tutela que se otorga en
la normativa peruana. Por último, se elaboran reflexiones respecto a la validez de la limitada
protección que se otorga frente a este tipo de contingencias laborales, así se presenta una
propuesta para tutelar estos eventos a través de los mecanismos de la seguridad social.
In this paper, will be analyzed the scope and limits of the protection granted by labor regulations about accidents occurred on the way to the workplace. The analysis has been carried out taking as a starting point the distinction between occupational health and safety regulations, which are intended to prevent risks; and, the regulations that provide coverage to workers against occupational accidents, that is, the insurance system for labor events. Subsequently, a study of the definitions of accidents occurred on the way to the workplace is carried out from its recognition in the comparative legislation, to later contrast it with the protection granted in the Peruvian regulations. Finally, reflections are made regarding the validity of the limited protection granted against this type of labor contingencies, thus presenting a proposal to protect these events through social security mechanisms.
