Resumen
En la presente investigación se analizará el alcance de la responsabilidad del empleador
por un accidente de trabajo ocurrido durante el teletrabajo. El análisis tiene como punto
de partida el estudio de la nueva Ley del Teletrabajo, Ley N° 31572, publicada el 12 de
setiembre del presente año, específicamente la regulación en materia de seguridad y salud
en el trabajo a fin de determinar si se brindan lineamientos sobre la responsabilidad del
empleador. Posteriormente, se realiza un estudio del alcance del accidente de trabajo y el
deber de prevención del empleador en el teletrabajo, tomando en consideración que son
los elementos que permiten imputar responsabilidad al empleador de acuerdo con lo
regulado en el Reglamento de la Ley de Seguridad y Salud en el Teletrabajo. Por último,
se analiza el alcance de la responsabilidad del empleador en la legislación comparada con
el objetivo de plantear una propuesta de mejora a nuestra normativa que recoja los
aspectos positivos.
In this paper will analyze the extent of the employer's responsibility for an accident at work that occurred during teleworking. The analysis has as its starting point the study of the new Teleworking Law, Law No. 31572, published on September 12 of this year, specifically the regulation on safety and health at work in order to determine if guidelines are provided on the responsibility of the employer. Subsequently, a study of the scope of the work accident and the employer's duty of prevention in teleworking is carried out, taking into consideration that they are the elements that allow the employer to be attributed responsibility in accordance with the regulations of the Law on Safety and Health in Telework. Finally, the scope of the employer's responsibility in the comparative legislation is analyzed with the aim of proposing an improvement proposal to our regulations that reflects the positive aspects.
