Resumen
El presente artículo académico tiene como finalidad realizar un análisis sobre el elemento
normativo “caso judicial o administrativo” del tipo penal de Tráfico de influencias, el
mismo que ha sido objeto de varias interpretaciones tanto en la doctrina como en la
jurisprudencia. Para abordar el objetivo planteado, el artículo académico se dividirá en
tres capítulos. En el primero, se realiza un análisis del tipo penal, en el que se da cuenta
de su evolución normativa, el bien jurídico protegido y los elementos del tipo objetivo.
En el segundo, después de un recuento por los instrumentos internacionales, la legislación
comparada y la jurisprudencia nacional, se propone la interpretación del elemento “caso
judicial o administrativo”. En el tercero, se aborda el principio de legalidad penal y la
interpretación teleológica del elemento normativo en cuestión. Finalmente, se concluye
que la interpretación del elemento “caso judicial o administrativo” debe ser amplia. Por
lo que, “caso judicial” debe comprender no solo los procesos del ámbito jurisdiccional,
sino los previos a este (investigación policial y fiscal), mientras que “caso
administrativo” debe entenderse como procedimiento administrativo. La metodología
empleada tiene como base la revisión de conceptos dogmáticos, los principios del derecho
penal y constitucional, así como los conceptos del derecho administrativo y procesal; para
lo cual, se recurrió a la doctrina nacional e internacional, así como a la jurisprudencia
emitida por el Poder Judicial y del Tribunal Constitucional.
The purpose of this academic article is to analyze the normative element "judicial or administrative case" of the criminal type of influence peddling, which has been the subject of several interpretations in both doctrine and jurisprudence. To address the proposed objective, the academic article will be divided into three chapters. The first section analyses the criminal nature of the offence, the evolution of regulations, the protected legal asset and the elements of the objective type. In the second, after a review by international instruments, comparative legislation and national jurisprudence, an interpretation of the element "judicial or administrative case" is proposed. The third explains the principle of criminal legality and the teleological interpretation of the normative element. Finally, it is concluded that the interpretation of the element "judicial or administrative case" should be broad. Thus, "judicial case" should include not only the judicial processes, but also those prior to this (police and fiscal investigation), while "administrative case" should be understood as an administrative procedure. The methodology used is based on the revision of dogmatic concepts, the principles of criminal and constitutional law, as well as the concepts of administrative and procedural law; to this end, national and international doctrine was used, as well as the jurisprudence issued by the judiciary and the Constitutional Court.
