Resumen
El presente trabajo académico tiene por finalidad analizar la jornada laboral de
los conductores de buses interprovinciales y la naturaleza de los descansos
intercalados que ellos tienen al ser considerados trabajadores intermitentes.
Dicho análisis permitirá determinar si la regulación peruana actual sobre dichos
descansos intercalados debe seguir considerándolos como tiempo de descanso
real para los conductores, lo que genera que no sean considerados parte de su
jornada laboral y, en consecuencia, no sean remunerados o compensados.
Los instrumentos normativos que serán utilizados para este análisis jurídico son
la Constitución Política del Perú, la Ley N°27181 Ley General de Transporte y
Tránsito Terrestre y su Reglamento, el TUO de la Ley de Jornada de Trabajo,
Horario y Trabajo en Sobretiempo (Decreto Legislativo N°854), así como
también, la normativa internacional de la Organización Internacional del Trabajo.
Asimismo, se empleará en este análisis jurisprudencia y doctrina nacional e
internacional sobre la regulación de la jornada laboral de los conductores de
buses interprovinciales.
De esta manera, se podrá señalar si la regulación actual de la jornada laboral de
los conductores de buses interprovinciales en el Perú es conforme con lo
señalado por la normativa internacional o si, por el contrario, requiere de una
modificación en aras de garantizar los derechos laborales de los conductores de
buses interprovinciales.
The purpose of this academic work is to analyze the workday of interprovincial bus drivers and the nature of the interspersed breaks that they have when they are considered intermittent workers. This analysis will determine whether the current Peruvian regulation on said interspersed breaks should continue to consider them as real rest time for drivers, which means that they are not considered part of their working day and, consequently, are not remunerated or compensated. The regulatory instruments that will be used for this legal analysis are the Political Constitution of Peru, Law No. 27181 General Law of Transportation and Land Transit and its Regulations, the TUO of the Law on Working Days, Schedules and Overtime Work (Decree Legislative No. 854), as well as the international regulations of the International Labor Organization. Likewise, national and international jurisprudence and doctrine on the regulation of the working hours of interprovincial bus drivers will be used in this analysis. In this way, it will be possible to indicate whether the current regulation of the working day of interprovincial bus drivers in Peru is in accordance with what is established by international regulations or if, on the contrary, it requires a modification in order to guarantee the rights employment of interprovincial bus drivers.
