La motivación y la prueba de oficio: racionalidad de la iniciativa probatoria del juez

Abstract

El trabajo analiza los nexos entre el deber de motivación de las resoluciones judiciales con la iniciativa probatoria del juez. Adhiriendo a la concepción epistemológica de la prueba y el de la motivación como justificación racional de la decisión, el Autor pone en evidencia la necesidad de que la resolución con la que se disponen pruebas de oficio, esté racionalmente justificada, proponiendo los corres-pondientes criterios.The work analyzes the connections between the duty to motivation of the judgments with the evidentiary initia-tive of judge. Adhering to the epistemological conception of the proof and motivation as a rational justification of the decision, the author shows the need for the resolution that orders evidence ex officio, it must be rationally justified, proposing the pertinent criteria.
