Afianzamiento del rol del personal policial en la Investigación Preliminar para fortalecer la Metodología de Investigación de la PNP, en el marco del nuevo modelo procesal penal

Resumen
Los efectivos policiales no pueden realizar análisis ni conclusiones en el actual
modelo de Informe Policial, por lo cual no pueden concluir con su ciclo metodológico
de investigación; esta situación ha propiciado una serie de discrepancias funcionales
con los fiscales, sobre todo en lo relacionado con la interoperatividad funcional, por
cuanto los fiscales prescinden en muchos del personal policial en la labor de
investigación criminal; contexto que se ha agudizado aún más por la deficiente
capacitación del personal policial en torno al rol que le corresponde en la
investigación preliminar. Se presenta como problema de investigación: “La deficiente
capacitación del personal policial, en torno al rol que le corresponde en la
Investigación Preliminar, menoscaba la Metodología de Investigación Policial, en el
contexto del nuevo proceso penal”. Una eficiente y adecuada capacitación del
personal policial en torno al rol que le corresponde en esta etapa, afianzará la
función constitucional de investigar y la capacidad operativa de la PNP, generando
un impacto positivo en la lucha contra la criminalidad.
Se han considerado cuatro dimensiones en la arquitectura del problema: sobre la
labor policial; sobre el proceso de capacitación del personal policial en torno a su rol
en la investigación preliminar; sobre la metodología de investigación policial en el
marco de la investigación preliminar y; sobre la interoperatividad entre fiscales y
policías en la investigación preliminar. De igual forma, se establecieron tres causas
principales sobre el problema de investigación: la abstención de la PNP, en el nuevo
Código Procesal Penal, para calificar jurídicamente los hechos que investiga; las
incapacidades técnicas del recurso humano policial para el ejercicio de su rol en la
investigación preliminar; la inadecuada interoperatividad funcional entre la PNP y el
Ministerio Público en torno a la investigación preliminar.
El problema de investigación fue reformulado en el siguiente contexto: “Los efectivos
policiales requieren mejorar sus capacidades técnicas en el ejercicio de su rol en la
investigación preliminar, porque actualmente tienen problemas en la aplicación de la
metodología de investigación policial, en el marco del nuevo modelo procesal penal”;
asimismo, al reflexionar sobre el problema reformulado se estableció el siguiente
desafío de innovación: ¿Cómo podemos mejorar las capacidades técnicas del

personal policial en el ejercicio de su rol en la investigación preliminar, para
fortalecer la metodología de investigación policial, en el contexto del nuevo proceso
penal, a través de un proceso tecnológico, educativo, inteligente y dinámico?
Se indagó sobre tres experiencias internacionales relacionadas que permitieron
concentrar ideas de cómo dar viabilidad al proyecto innovador, con miras a mejorar
la capacitación del personal policial en cuanto a sus capacidades técnicas en el
ejercicio de su rol en la investigación preliminar, con la finalidad de fortalecer la
metodología de investigación policial, en el marco del nuevo modelo procesal penal.
El prototipo innovador fue testeado, culminándose la versión final en alta resolución.
Este prototipo será desplegado en la nube de Amazon, usando AWS, a través de
una multiplataforma adaptable a cualquier dispositivo móvil y un acceso URL. El
personal podrá aprovechar las bondades de este prototipo con un simple acceso
desde su celular, tablet, laptop o cualquier otro dispositivo móvil de comunicación.
Este nuevo proceso educativo también permitirá elevar la imagen y prestigio de la
PNP, y recuperar la confianza de la población.
Como conclusión, se establecerá que el presente proyecto de innovación contribuirá
en la mejora del desempeño del personal policial en la investigación preliminar y en
el contexto de la lucha contra la criminalidad, en torno a sus capacidades,
habilidades y conocimientos especializados. Por último, se anexa al presente trabajo
de investigación el “Manual para capacitación del personal policial en torno a su rol
en la investigación preliminar, en el contexto del nuevo proceso penal”, como un
aporte y contribución personal a la institución policial, en aras de superar los
problemas suscitados en la aplicación de la metodología de investigación policial, en
el marco del nuevo modelo procesal penal, y poder brindar a los efectivos policiales
un instrumento formal que les sirva para el debido cumplimiento de su misión.
Police officers can’t provide analyzes or conclusions in the current Police Report model, for which they cannot conclude with their methodological cycle of investigation; this situation has led to a series of functional discrepancies with prosecutors, especially in relation to functional interoperability, since prosecutors dispense with many of the police personnel in criminal investigation work; context that has been further exacerbated by the poor training of police personnel regarding the role that corresponds to them in the preliminary investigation. It is presented as a research problem: "The poor training of police personnel, regarding the role that corresponds to them in the Preliminary Investigation, undermines the Police Investigation Methodology, within the framework of the new criminal procedure model." Efficient and adequate training of police personnel regarding the role that corresponds to them in this stage will strengthen the constitutional function of investigating and the operational capacity of the PNP, showing a positive impact in the fight against crime. Four dimensions have been considered in the architecture of the problem: on police work; about the training process for police personnel regarding their role in the preliminary investigation; on the methodology of police investigation in the framework of the preliminary investigation and; on the interoperability between prosecutors and police in the preliminary investigation. In the same way, three main causes were established on the investigation problem: the abstention of the PNP, in the new Code of Criminal Procedure, to legally qualify the facts that it investigates; the technical incapacities of the police human resources for the exercise of their role in the preliminary investigation and; the inadequate functional interoperability between the PNP and the Public Ministry regarding the preliminary investigation. The research problem was reformulated: "Police officers need to improve their technical skills in the exercise of their role in the preliminary investigation, which they can do in the application of the police investigation methodology, within the framework of the new criminal procedure model"; likewise, when reflecting on the reformulated problem, the following innovation challenge was established: How can we improve the technical skills of police personnel in the exercise of their role in the v preliminary investigation, to strengthen the police investigation methodology, within the framework of the new criminal procedure model, through a technological, educational, intelligent and dynamic process? Three related international experiences were investigated that allowed concentrating ideas on how to make the innovative project viable, looking forward to improve the technical skills of police personnel in the exercise of their role in the preliminary investigation, in order to strengthen the police investigation methodology, within the framework of the new criminal procedure model. The innovative prototype was tested, culminating in the final version in high resolution. This prototype will be deployed in the Amazon cloud, using AWS (Amazon Web Services), exposed through a multiplatform, adaptable to any mobile device and the access is through a URL. The police personnel will be able to take advantage of the benefits of this prototype with simple access from their cell phone, tablet, laptop or any other mobile communication device. This new educational process will also allow raising the image and institutional prestige, and recover the confidence of the population in its Police. In conclusion, it is established that this innovation project will contribute to improving the skills, abilities and specialized knowledge of police personnel, in the field of Police Investigation Methodology and in the context of the fight against common and organized crime. Finally, the "Manual for training police personnel regarding their role in the preliminary investigation, within the framework of the new Criminal Procedure Code" is attached to this research work, as a personal contribution to the police institution, in order to overcome the problems raised in the application of the police investigation methodology, within the framework of the new criminal procedure model, and to be able to provide police officers with a formal instrument that will serve them for the due fulfillment of their mission.
