De la Ley de Promoción Agraria a la Ley del Régimen Laboral Agrario y de Incentivos para el sector agrario y riego, agroexportador y agroindustrial: Una aproximación desde el derecho administrativo

Abstract

En los últimos días del año 2020 hemos sido testigo de innumerables actos de protesta en contra del régimen de promoción agrario aprobado a inicio del presente siglo a través de la Ley Nº 27360 y su modificación a través del Decreto de Urgencia Nº 043-2019. Este descontento social se traduce en aspectos vinculados a las relaciones laborales suscitadas. No obstante, es necesario ahondar en los antecedentes y hechos y analizar cuan de novedoso es el tránsito de un régimen promotor a un régimen garantista. A través del presente artículo se hace una aproximación a la nueva Ley Nº 31110 desde la óptica del derecho administrativo con énfasis en los aspectos agrarios más relevantes, ello a fin de ofrecer una mirada objetiva acerca de los retos por cumplir con el marco normativo en base al objeto previsto en el nuevo régimen.In the last days of the year 2020 we have witnessed countless acts of protest against the agricultural promotion regime approved at the beginning of this century through Law N° 27360 and its amendment through Emergency Decree No. 043-2019. This social discontent results in aspects linked to the industrial relations aroused. However, it is necessary to delve into the background and facts and to analyze how novel the transit from a promoting regime to a guarantee regime is. This article provides an approximation of the new Law No. 31110 from the perspective of administrative law with an emphasis on the most relevant agricultural aspects, in order to offer an objective view on the challenges of complying with the regulatory framework based on the object provided for in the new regime.
