Resumen
En la perspectiva de aportar en las políticas de desarrollo socio económico y
ambiental en el marco de las relaciones interinstitucionales, empresa minera, gobierno
local y la comunidad, basada en evidencias, se ha desarrollado el presente trabajo
de investigación tomando como base la experiencia desarrollada por la
Municipalidad Provincial de Espinar y la Empresa Minera Glencore Xstrata Copper
Antapacay a través del “Convenio Marco Social y Ambiental” en la Provincia de
Espinar, Departamento de Cusco. La presente tesis analiza los aspectos
fundamentales del Convenio Marco, como los mecanismos de articulación y
concertación, instrumentos de gestión, nivel de participación, competencias y
percepción de los actores involucrados. Los resultados determinan que los
mecanismos de articulación y concertación institucionalizados para implementar el
Convenio Marco Social y Ambiental, existe solo, en un espacio de dialogo y
canal de articulación, denominado “Comité de Gestión del Convenio Marco”, a
pesar de que el Reglamento de Organización y Funciones del Comité de
Concertación de la Provincia de Espinar, establece la existencia de tres espacios
de dialogo y articulación: a) La Asamblea General del Comité de Concertación. b) El
Comité de Gestión. c) El Comité de Ejecución. Por lo que el grado de articulación
es incipiente al estar implementado de manera parcial. Sobre los factores que están
limitando la existencia de espacios de concertación y articulación se encuentran: Los
insuficientes espacios de concertación y dialogo, el desequilibrio de competencias
de los actores involucrados, implementación parcial de los instrumentos de gestión
y la influencia de los intereses de la empresa minera y los factores que facilitan la
existencia de espacios de concertación son: La representatividad de los actores
involucrados del Convenio Marco, reuniones permanentes del Comité de Gestión,
existencia de normas sociales de responsabilidad social de la actividad minera. La
investigación evidencia la percepción de los actores involucrados de establecer
medidas relacionadas a la mejora en la implementación y son priorizadas y
jerarquizadas por los entrevistados. La investigación es oportuna para evaluar la
experiencia del Convenio Marco y su contribución efectiva en el aspecto social.
Desde la Gerencia Social, se busca identificar, analizar y proponer la optimización de
la intervención social. Los hallazgos, conclusiones y las alternativas planteadas
serán presentadas a los actores involucrados para que sean implementadas, lo
que le da sostenibilidad a la investigación.
In the perspective of providing socio-economic and environmental development policies within the framework of inter-institutional relations, mining company, local government and the community, based on evidence, this research work has been developed based on the experience developed by the Provincial Municipality of Espinar and the Mining Company Glencore Xstrata Copper Antapacay through the "Social and Environmental Framework Agreement" in the Province of Espinar, Department of Cusco. This thesis analyzes the fundamental aspects of the Framework Agreement, such as coordination and coordination mechanisms, management instruments, level of participation, competences and perception of the actors involved. The results determine that the mechanisms of articulation and institutionalized agreement to implement the Social and Environmental Framework Agreement exist only in a space of dialogue and channel of articulation, called "Committee of Management of the Framework Agreement", even though the Regulation of Organization and Functions of the Concertation Committee of the Province of Espinar, establishes the existence of three spaces for dialogue and articulation: a) The General Assembly of the Coordination Committee. b) The Management Committee. c) The Execution Committee. So the degree of articulation is incipient to be partially implemented. On the factors that are limiting the existence of spaces for coordination and articulation are: The insufficient spaces for consultation and dialogue, the imbalance of competencies of the actors involved, partial implementation of management instruments and the influence of the interests of the company mining and the factors that facilitate the existence of spaces of agreement are: The representativeness of the actors involved in the Framework Agreement, permanent meetings of the Management Committee, existence of social norms of social responsibility of the mining activity. The research evidences the perception of the actors involved of establishing measures related to the improvement in the implementation and they are prioritized and hierarchized by the interviewees. The research is timely to evaluate the experience of the Framework Agreement and its effective contribution in the social aspect. From Social Management, seeks to identify, analyze and propose the optimization of social intervention. The findings, conclusions and alternatives proposed will be presented to the stakeholders involved so that they can be implemented, which gives sustainability to the research.
