Resumen
En el presente trabajo analizamos la responsabilidad administrativa de los
empleadores por el incumplimiento de nuevas obligaciones o mejoras en materia
de facilidades sindicales introducidas por convenio colectivo, a partir de la
reflexión de la tipificación como infracción grave del incumplimiento de las
disposiciones normativas sobre las facilidades sindicales y de la finalidad del
sistema de inspección de trabajo, como una tutela adicional para la garantía de
los derechos fundamentales laborales del trabajador. La naturaleza dual de los
tipos de cláusula del convenio colectivo nos lleva a la conclusión que la
tipificación de la infracción administrativa referida al incumplimiento de las
facilidades sindicales puede ser llenada o complementada por las cláusulas
normativas de los convenios colectivos, mas no, por las cláusulas obligacionales.
In this paper, we analyze the administrative responsibility of employers for non compliance with new obligations or improvements related to the granting of facilities for the exercise of union activity introduced by collective agreement, based on the study of the clasification as a seriuos infracctionof non-compliance with the normative provisions related to the granting of facilities for the exercise of union activity and the purpose of the labor inspection system, as an dditional protection for the guarantee of the fundamental rights of the worker. The dual nature of the types of clause in the collective agreement leads us to the conclusion that the classificaction of administrative infraction referring to the failure to comply with union facilities can be complemented by the normative clauses of the collective agreements, but not by the obligatory clauses.
