El principio de adecuación social, ¿un mero formalismo?

Abstract
A lo largo de las resoluciones emitidas por los órganos del INDECOPI se ha
cuestionado la afectación al principio de adecuación social, que se encuentra
previsto en el artículo 18° de la Ley de Represión de la Competencia Desleal; sin
embargo, estas han sido declaradas infundadas. El presente artículo busca
cuestionar los argumentos presentados tanto por la Comisión de Fiscalización
de la Competencia Desleal como por la Sala de Defensa de la Competencia N°
1 referentes a la libertad de expresión y la libertad de empresa, así como el
utilizado respecto al uso de las licencias publicitarias con la finalidad de
determinar si estos pueden contribuir a la difusión de los estereotipos basados
en el género. Asimismo, se busca identificar si es adecuada la tipificación del
cuestionado artículo para perseguir los objetivos deseados.
Throughout the resolutions issued by INDECOPI, the affectation of the principle of social adequacy, which is provided in article 18 of the Law for the Repression of Unfair Competition, has been questioned; however, these have been declared unfounded. This article seeks to question the arguments presented by both the Commission for the Control of Unfair Competition and the Chamber for the Defense of Competition No. 1 regarding freedom of expression and freedom of business, as well as the one used regarding the use of advertising licenses in order to determine if they can contribute to the spread of gender-based stereotypes. Likewise, it seeks to identify whether the classification of the questioned article is adequate to pursue the desired objectives.
