El NEXUS, la Neutralidad de la Red y los Derechos Fundamentales

Abstract

El presente artículo efectúa un análisis sobre la figura ficticia del Nexus como punto central del tráfico del Internet, la posibilidad de su existencia y la conveniencia de su permisibilidad o no. El autor expone los argumentos para negar la existencia de un NEXUS y la importancia de la Neutralidad de la Red como medio para garantizar un Internet libre y funcional como lo hace hasta la actualidad; adicionalmente, expone en qué consiste el Principio de Neutralidad de la Red como candado para impedir los efectos negativos del uso irresponsable de Internet.This paper analyzes the fictional figure of the Nexus as a central point of the Internet traffic, the possibility of its existence and the convenience of its permissibility or not. The author exposes the arguments to deny the existence of a NEXUS and the importance of Net Neutrality as a mean to guarantee a free and functional Internet, as it does up to now; additionally, he explains what is the Net Neutrality Principle as a padlock to prevent the negative effects of the irresponsible use of Internet.
