Abstract
Durante el desarrollo de un informe o dictamen pericial se presentan dificultades que pueden llegar a incidir significativamente en su valor probatorio. Ello se puede advertir en la selección del perito; en la determinación del alcance del informe; en la forma de acceso a la documentación del proceso; en las comunicaciones que el perito puede o no tener con las partes, con sus respectivos expertos y con el propio árbitro; en la selección de metodologías para evaluar costos y plazos; en las cuestiones jurídicas vinculadas con los aspectos técnicos de la pericia; en la audiencia de peritaje; y en el propio contenido del informe o dictamen. En este artículo, buscaremos identificar las dificultades que usualmente se presentan, con algunas sugerencias de posibles soluciones.
During the development of an expert report, difficulties arise that may have a significant impact on its probatory value. This can be noted in the selection of the expert; in determining the scope of the report; in the form of access to the documentation of the process; in communications that the expert may or may not have with the parties, their respective experts, and with the arbitrator; in the selection of methodologies to evaluate costs and extensions of time; in legal matters related to the technical aspects of the report; in the expert hearing; and in the content of the report itself. In this article we will seek to identify the difficulties that usually arise, with some proposals of possible solutions.
