Después de trescientos cuarenta años de discriminación racial, Sudáfrica tiene una nueva Constitución cuyo propósito es brindar los fundamentos legales para 'una sociedad abierta y democrática basada en la libertad y en la igualdad.'La transición del apartheid a la democracia tendrá éxito en la medida en que pueda revertir el legado del apartheid, y especialmente, en la medida en que alcance un grado significativo de redistribución. En este campo, como en otros de la 'nueva Sudáfrica', la Constitución desempeñará un papel preponderante.
