Cuando la Constitución llegó en diciembre de 1812, ya había en el Cuzco un movimiento bien organizado, pero también había gran malestar por el excesivo retraso con que llegaba desde Lima: Cuanto más se demoraba en la capital de Lima sus ejemplares, tanto más se encendía el deseo de este generoso vecindario en ser el momento feliz de su regeneración política. Según el abogado Rafael Ramírez de Arellano, líder del constitucionalismo Cuzqueño, ni bien llegó al Cuzco la Constitución, el presidente de la Audiencia Mateo Pumacahua, el regente Manuel Pardo y el escribano Chacón y Becerra, tenían el propósito de no cumplirla; para ello habían esparcido la voz de que esta era perjudicial para el pueblo.
