Abstract
Este informe jurídico tiene por finalidad realizar un análisis crítico de las resoluciones
emitidas por el Poder Judicial, las cuales culminaron con la Casación Laboral N° 10956-
2017-TACNA; a través de la cual, la Corte Suprema asumió un criterio de defensa en
cuanto al derecho al pago del lucro cesante y de la indemnización por daño moral, a
consecuencia del despido incausado que disolvió el vínculo laboral entre el Proyecto
Especial Afianzamiento y Ampliación de los Recursos Hídricos de Tacna – PET y la
demandante Marisol Calisaya. En los últimos años los juzgados han emitido diversos
pronunciamientos que han ido delimitando las pretensiones de lucro cesante y daño
moral, con imprecisiones o conclusiones contradictorias de los administradores de
justicia, generando una inestabilidad con las decisiones y pronunciamientos
jurisprudenciales. Por ello, el caso de Marisol Calisaya reviste no menor importancia y
corresponde analizar si los fundamentos de las instancias judiciales se sustentan en
razones jurídicas y lógicas. De igual manera, resulta necesario entender cuáles fueron
los argumentos utilizados a lo largo del proceso y cómo el presente caso debería
garantizar la uniformidad de criterios que apliquen los órganos jurisdiccionales,
debiendo estos ser los más acertados a fin de asegurar predictibilidad en futuros casos
similares.
