El papel de las Naciones Unidas en el reconocimiento de los Estados. Una reflexión a partir del caso palestino

Abstract

El presente artículo demuestra el papel de las Naciones Unidas en el reconocimiento de los Estados a propósito del caso Palestino. Existen diversos trabajos en los que se ha estudiado si es que Palestina puede ser calificada como un Estado; sin embargo, estos se han realizado en base a concepciones tradicionales sobre el reconocimiento de los Estados. Por ello, se propone evaluar el tema desde la teoría que defiende el reconocimiento de los Estados por parte de una organización internacional. Para ello, se ha optado por dividir el cuerpo de este trabajo en dos secciones. Sin embargo, de manera previa al desarrollo de estas, se presentará el marco metodológico y el marco teóriconormativo que serán la base de la investigación. Posteriormente, la primera sección será dedicada exclusivamente a indagar el papel de las Naciones Unidas en el reconocimiento de los Estados. En ese sentido, se revisará si existe algún procedimiento establecido en el seno de esa organización para el reconocimiento estatal. Además, se expondrán aquellos casos en los que las Naciones Unidas han tenido un papel activo para consolidar o negar el reconocimiento de un Estado. Por otro lado, la segunda sección buscará responder si es que el reconocimiento de Palestina como un Estado por parte de las Naciones Unidas permitiría que esta pueda ejercer plenamente su subjetividad internacional.

This article will demonstrate the role of the United Nations in the recognition of the States regarding the Palestinian case. There are several studies that have studied whether Palestine can be qualified as a state; however, these have been carried out according to traditional conceptions of state recognition. For this reason, we propose to evaluate the issue from the perspective of the theory that defends the recognition of States by an international organization. For this purpose, we have chosen to divide the body of this paper into two sections. Nevertheless, previously, the methodological framework and the theoreticalnormative framework that will be the basis of the research will be presented. Subsequently, the first section will be focused exclusively on the role of the United Nations in the recognition of States. Thus, we will review whether there is any procedure established inside that organization for state recognition. In addition, cases in which the United Nations has played an active role in consolidating or denying recognition of a State will be presented. On the other hand, the second section will seek to answer whether the recognition of Palestine as a State by the United Nations would allow it to fully exercise its international subjectivity.
