This academic work aims to analyze the legal framework and the main national public policies aimed at protecting people from employment discrimination due to sexual orientation and gender identity conditions, identifying the need for a Protocol on labor inspection for the care of the LGBTIQ population. The first part will analyze the main instruments of the universal and inter-American system of human rights, as well as the Political Constitution of Peru and other normative bodies that regulate the two phases of the labor relationship; in the second part, the main national public policies will be addressed, starting from what is established in the National Human Rights Plan, identifying the main limitations regarding the provision of strategic actions, as well as the absence of participation of institutions of the labor sector; and finally, in the last part, the need to strengthen the labor inspection system will be exposed, through the promulgation of a care protocol with a gender focus; since it is essential to strengthen the Inspection System as a tool to safeguard the effectiveness of the fundamental rights of LGBTIQ people in the framework of labor relations and equal opportunities without discrimination....

The general objective of this paper is to analyze the legally relevant aspects of the Resolution 2135-2012/SC2-INDECOPI; in which the Tribunal of Defense of Competition, as a court of appeal, resolves a case involving discrimination against a person with Down syndrome by an insurance company in a consumer relationship. In order to carry out the analysis of the aforementioned resolution, we have used a descriptive and deductive critical method of the main legal categories and regulation involved in the case and its application; including legal precedents relevant to the case. After applying this methodology, we have reached two main conclusions. The first one is that the disparate treatment performed by the defendant is devoid of objective and reasonable reasons; while the second one is that such differential treatment constitutes an act of consumer discrimination, typified as a regulatory infringement of an administrative nature, outlawed by the Constitution....

This report analyzes resolution N.° 0534-2019/SPC-INDECOPI, issued by the Specialized Court for Consumer Protection, in which it is determined that the Chira's Nightclub has violated the mandate of non-discrimination in consumption by having denied the entry to Miss Torres and companions without a justified and reasonable cause. Also, it aims to promote a reflection on cases of discrimination in consumption based on gender identity. Although articles 38 and 39 of the Consumer Protection Code centrally typify the components of the discriminatory act and how the burden of proof is executed in this type of cases, it is not enough to comprehensively examine the case that we are dealing with. For this reason, in addition to consider what is established by the Court regarding the prohibited category of gender identity and its importance, I develop and apply international and national regulations, doctrine and jurisprudence to have a broader panorama about the inclusion of gender identity. as a prohibited reason for discrimination and the evidentiary difficulty in cases of discrimination in order to determine whether the reasons and measures adopted by the Court have been impartial, objective and effective with the special protection the LGBTIQ+ community deserve. Finally, I conclude in a central way that the mandate of non-discrimination in consumption has been violated because the Nightclub has undermined the exercise of a right by making a differentiated treatment, based on prohibited grounds of discrimination, and without an objective and reasonable cause....

In 2019, the Specialized Court for Consumer Protection of the National Institute for the Defense of Free Competition and Protection of Intellectual Property (hereinafter, INDECOPI, for its acronym in Spanish) made a change of criteria regarding the scope of the legal figures contained within article 38 of the Consumer Protection Code. In this sense, although previously the coexistence of two alleged infringers was understood, that is, unlawful differential treatment and discrimination, currently said article only encompasses the matter of discrimination. However, it is necessary to begin to ask ourselves if the change in criteria regarding discrimination has generated some kind of benefit or detriment in communities that have historically suffered discriminatory treatment. In particular, this paper focuses on discrimination in consumption suffered by the LGTBI+ community. In this regard, the history of the inclusion of the figure of discrimination in consumption and the criteria that INDECOPI has implemented are addressed. Likewise, the concept of discrimination used by the Constitutional Court and the human rights doctrine is identified. Finally, we will analyze the criteria that INDECOPI has had regarding cases of discrimination against LGTBI+ people, as well as if the change in criteria has generated a reinforcement of their protection or if, on the contrary, it has not been relevant or has not achieved a greater contribution in the analysis of discrimination against that community....
