La revista Derecho PUCP, fundada en 1944, publica artículos de investigación jurídica o interdisciplinaria inéditos y originales, los cuales son revisados por pares externos que han publicado investigaciones similares previamente. Las evaluaciones se realizan de forma anónima (sistema doble ciego) y versan sobre la calidad y validez de los argumentos expresados en los artículos. Cuenta con tres secciones: (i) Sección Principal, (ii) Miscelánea e (iii) Interdisciplinaria.
La periodicidad de Derecho PUCP es semestral, apareciendo, tanto en su soporte físico como en su versión digital, en el primer día del periodo de publicación. El primer número de la revista abarca el periodo de junio a noviembre, y el segundo, de diciembre a mayo.

Humanitarización de las movilidades por salud y visado por tratamiento médico(Pontificia Universidad Católica del Perú, 2023-11-28) Basualdo, LourdesThis article aims to analyze certain manifestations of «humanitarianism» in the control and regulation of health mobilities in the Argentine context. At an empirical level, it investigates one of the political uses of the health visa, from the figure of «patients under medical treatment» contained in the Migration Law, based on the transcontinental mobility experience of a girl from Sub-Saharan Africa who entered Argentina in the mid-2010s under this migratory category. Through a qualitative methodology that combines participant observations and interviews developed between 2016 and 2019, the article shows the humanitarianization work through which people or groups with greater restrictions on mobility, in the framework of the reconfiguration of the “South American regime of migration and borders”, come to be produced as deserving of humanitarian treatment, as well as the tensions and conflicts experienced during the exercise of humanitarian control of mobility. It argues that, in the process of mobility for health under study, humanitarian control is configured from the articulation between the imposition and access to visa measures, the production of “callers” and certain political uses of humanitarian imagery.Item Metadata only Migración «extrarregional» y fronteras temporales en el contexto sudamericano reciente. Migración haitiana e «intermitencia legal» en Argentina(Pontificia Universidad Católica del Perú, 2023-05-23) Trabalón, CarinaThis article aims to analyze the tensions and reconfigurations that operate between illegalization, temporary borders and daily life of Haitians in Argentina, in connection with larger regional processes linked to the political government of Caribbean and African “extrarregional” migration in the recent South American context. I argue that the control over the modes of “permanence” of migrants of Haitian origin in Argentina represents a paradigmatic case that allows exposing regional trends in progress during the 2010s, based on the political exclusion of the refuge, the existence of differential criteria of residence, the reinforcement of illegalization mechanisms and the multiplication of temporary borders. In addition, I maintain that one of the main manifestations of these political processes is the “legal intermittency” referring to the conflictive and changing dynamics that is established between legal-political practices, temporary experiences of control and negotiation strategies of the subjects. The article adopts a qualitative methodological approach that includes, firstly, a documentary analysis of regulations and policies implemented at the regional level during the 2010s on Caribbean and African migration in Argentina, Brazil, Chile and Ecuador. Second, a participant observation and interviews conducted with migrants of Haitian origin between 2017 and 2019 in two cities in Argentina. I conclude that the link between legal borders and temporary borders constitutes a key aspect to understand both the political-administrative realities of the “new” migrations in the South American context, as well as the historically situated ways in which “configurations of illegality” permeate the projects of life and forms of resistance of specific national and social groups.Item Metadata only La ausencia del Defensor del Pueblo en Argentina: siete años sin representación colectiva(Pontificia Universidad Católica del Perú. Likewise, the normative origins of the organ are reviewed, in order to understand its value and democratic mission. In the ruling entitled Center for Studies for the Promotion of Equality and Solidarity and Others and the Ministry of Energy and Mining under Collective Protection (Centro de Estudios para la Promoción de la Igualdad y la Solidaridad y otros c/ Ministerio de Energía y Minería s/ amparo colectivo), issued on August 18, 2016, the Supreme Court of Justice of the Nation exhorted the Congress of the Nation to appoint an Ombudsman in accordance with the provisions conferred on it by article 86 of the National Constitution. The work exposes and glosses the comments that the newspaper La Nación of Buenos Aires, one of the most important in the country, dedicated to the process of editing and enactment of the Code. Fondo Editorial, 2012-06-21) Goldin, AdriánLabor reform and counter-reform in Argentina, simple chronic of a pendulum processAfter placing it in the context of the processes of labor reforms produced in Latin America in the early 90’s (its inspiration, its dynamics, its actors), the article considers in particular the case of Argentina. Inthat assignment, it examines the labor reforms that took place there from dominant perspectives - external flexibility, internal flexibility, reduction and variation of costs, collective labor relations - confirming a strong deregulated activism in the field of individual relations, while it was verified a high administrative interventionism of decentralized bias with a limited institutional transformation in collective relations.At the end of that decade, it had already been clear that those strategies haven’t had a virtuous effect on the social labor situation or the labor market. In this context, a new government that comes into power in 2003, leaves without effect a good part of those reforms and instead it undertakes a process of institutional reconfiguration of the legal system of labor protection: a systematic increase of the Living Wage, strengthening of the collective wage bargaining - with the consequent tendential improvement of wages of workers in the formal sector - and, by virtue of parliamentary initiatives, a sequence of introduction of micro-reforms always oriented to increase the protection of workers, which as a whole would have to involve a remarkable recovery of the tutelary bias of labor regulations.Item Metadata only Indicadores PER y sostenibilidad en la normativa sobre bosques cultivados en Argentina(Pontificia Universidad Católica del Perú. Fondo Editorial, 2018-05-29) Minaverry, Clara MaríaThis paper is focused on the regulation and institutional development contrasts of planted forests at Northeast, Northwest and New Cuyo regions in Argentina, taking into consideration «traditional» and «extended» environmental sustainability principle parameters. It is important to add that this principle was highly exceeded by other environmental management paradigms, but they are not suitable to be applied to implanted forests regulations in Argentina. Also, it refers to the contribution provided by legal international instruments and regional regulations. One of the most original approaches of this research is that PER indicators (Pressure, Condition and Response) were applied and adjusted to the legal arena. Finally we can state that planted forests regulations focuses on a limited horizon of production maximization, highlighting economic and forests commercial activties.Item Metadata only La mitigación de daños en la responsabilidad por incumplimiento contractual: breve análisis comparado en el derecho civil de Argentina y Perú(Pontificia Universidad Católica del Perú. Fondo Editorial, 2018-05-29) Ugarte Mostajo, DanielThe civil codes of Argentina and Perú are two of the few South American civil laws that, with different legal formulas, recognize on the creditor party a burden or duty of mitigate damages. On this basis, this paper aims to arrive, after a general approach to the duty or burden of mitigate damages in case of breach of contract, to a brief comparative analysis about the regulation that this figure has received in both civil codes, dealing with matters related not only to the structure and content of rules concerning this duty, but also to the juridical nature and foundations of the mitigation. All in order to stablish the existing similarities and differences between rules that incorporate the duty to mitigate damages in the civil codes of Argentina and Perú, the possibility of finding a common juridical foundation to both legislations, and the incidence of such a foundation in the interpretative scope of the rules mentioned.Item Metadata only Fundamentos jurídicos de la responsabilidad extracontractual del Estado en el Derecho argentino(Pontificia Universidad Católica del Perú. Fondo Editorial, 2011-06-01) Botassi, CarlosEn la República Argentina, el dogma de la irresponsabilidad extracontractual del Estado recién fue abandonado en 1933, cuando la Corte Suprema de Justicia de la Nación dictó sentencia en el caso «Tomás Devoto y Cía.». Tanto la doctrina como la jurisprudencia del referido Tribunal fundamentaron la obligación oficial de reparar los daños causas con su actividad lícita o ilícita, en las teorías sobre el deber de reparar los daños causados por los dependientes, la deficiente prestación de los servicios públicos y la expropiación. Existe actualmente un gran desarrollo de la responsabilidad estatal, aunque, debido a las leyes de emergencia y consolidación de deudas, una vez obtenida una sentencia de condena contra el Fisco, cabe hacer efectiva la solución del grave problema.Item Metadata only ¿Regular o competir? Fondo Editorial, 2016-05-25) Aguilar Valdez, Oscar RafaelThe purpose of this article is to highlight the importance of the Proportionality Principle as a valid legal criterion to determine when a given industry must be ex ante regulated by the Government through a specific sectorial regulatory framework or whether the application of the general antitrust and competition laws to such industry must be considered as a valid alternative. To this ends, this article analyzes the case of the Argentinean Law of Audiovisual Communications Services as it was treated by the Supreme Court of Argentina in the Grupo Clarín case.
