In particular, tribunals can regularly exercise a varying scope of jurisdiction when they determine the legality requirement that demands foreign investments to be made in accordance with the law of the host state.In this paper, the author seeks to analyze the decision rendered by the tribunal in Bear Creek v. Peru, in which the Canadian mining company alleged that the Peruvian State breach, inter alia, expropriation protections under the Canada-Peru Free Trade Agreement in relation to its investment in the silver mining project of Santa Ana. In order to achieve this aim, in the first chapter, he addresses three key issues regarding the tribunal’s jurisdiction, the rights on which the company based its claim and the arguably prerequisite of legality or good faith for the tribunal’s exercise of jurisdiction. In the second chapter, he analyzes the validity of the tribunal’s interpretation on the legality requirement for investment as an implicit element in the relevant treaty to determine the tribunal’s jurisdiction.Item Metadata only ¿Cómo lograr la anulación de un Laudo por corrupción en sus tribunales?: Lecciones aprendidas del caso ONCOSERV(Pontificia Universidad Católica del Perú, 2017-09-11) Talavera Cano, AndrésThe Arbitration is a one – time process instance in which the parties submit in an arbitrator to settle a dispute between them. The annulment of this process occurs through an exceptional remedy before the judicial court which finds sustenance in a serious violation of due process.In the present article, the author analyzes the case “Oncoserv v. Regional Government of Arequipa“, which has set a milestone in the history of Arbitration in Peru due to its unfortunate link with corruption. The intelligent use of penalties will safeguard and maintain the economic balance of the contracts, thus maintaining the profitability of business operations pursued through them.Item Metadata only ¿El Sistema del Amigable Componedor Podría Ser el Respaldo que Necesita el Procurador para Poder Transar las Controversias y No Someterlas a Arbitraje?(Pontificia Universidad Católica del Perú, 2015) Talavera Cano, Andrés; Olórtegui Huamán, JulioEs conocido el caso del procurador público que ante la posibilidad de transar los conflictos que surgen entre las entidades públicas y los contratistas, prefiere llevarlos a arbitraje con los mayores costos que dicha decisión genera para el Estado. El motivo responde a la preocupación de que se cuestione «la razonabilidad de su decisión de transar» imputándole responsabilidad mediante acciones de control.El presente artículo tiene como finalidad traer a discusión esta problemática así como una posible solución. De esta forma, teniendo en consideración la experiencia colombiana así como su reciente regulación en el Reglamento de la Ley de APPs, los autores proponen incluir en la Nueva Ley de Contrataciones del Estado la figura del «Amigable Componedor» como mecanismo alternativo de solución amigable de conflictos.
