Resumen
El presente informe tiene como finalidad analizar la Resolución N° 5 del
Expediente N° 00205-2022-0-1817-SP-CO-01, mediante el cual se discute la
anulación de laudo bajo la causal del literal b) numeral 1 del artículo del Decreto
Legislativo N° 1071 emitido el 22 de agosto de 2022 entre el Hospital Nacional
Dos de Mayo que actúa como demandante, y el Centro Médico Naval Cirujano
Mayor Santiago Távara de la Marina de Guerra del Perú y la Dirección de Salud
que actúan como demandados.
En este proceso se discute si el Tribunal Arbitral Unipersonal emitió una decisión
debidamente motivada conforme lo establece la ley. Para ello se realizará un
análisis exhaustivo si la causal invocada para la anulación de laudo es la más
adecuada. Asimismo, se expondrá la relevancia de las decisiones motivadas y
cuáles serían los estándares idóneos de estos para evitar recurrir al recurso de
anulación de laudo.
En ese sentido, concluimos que la sí existió una vulneración al derecho de
motivación en el caso presentado y que la causal correcta que se debió alegar
está establecida en el literal c) numeral 1 del artículo del Decreto Legislativo N°
1071 para fundamentar la falta de motivación en el laudo arbitral.
The purpose of this report is to analyze Resolution No. 5 of File No. 00205-2022- 0-1817-SP-CO-01, through which the annulment of the award is discussed under the cause of literal b) numeral 1 of the article of Legislative Decree No. 1071 issued on August 22, 2022 between the Dos de Mayo National Hospital, which acts as plaintiff, and the Cirujano Mayor Santiago Távara Naval Medical Center of the Peruvian Navy and the Health Directorate, which acts as defendants . In this process, it is discussed whether the Unipersonal Arbitration Court issued a duly reasoned decision as established by law. To do this, an exhaustive analysis will be carried out if the cause invoked for the annulment of the award is the most appropriate. Likewise, the relevance of the motivated decisions will be explained and what would be the ideal standards for them to avoid resorting to the appeal for annulment of the award. In that sense, we conclude that there was a violation of the right to motivation in the case presented and that the correct cause that should have been alleged is established in literal c) numeral 1 of the article of Legislative Decree No. 1071 to substantiate the lack of motivation in the arbitration award.
