El control de la función administrativa en los procedimientos de evaluación de las iniciativas privadas: en defensa del interés privado y del interés público

Resumen
Las iniciativas privadas son mecanismos de promoción de la inversión privada que el Estado fomenta como instrumento de desarrollo, dentro del modelo constitucional económico “Economía Social de Mercado”, por tanto las decisiones administrativas deben estar orientadas a promoverlas y generar incentivos para la presentación de propuestas de proyectos por este medio..
La presente investigación estudia los procedimientos administrativos de evaluación de las iniciativas privadas y el rol de la administración pública. Las iniciativas privadas son calificadas normativamente como peticiones de gracia debido al contenido discrecional de la decisión administrativa que las califica, por lo que se analizan las implicancias y los alcances de esta naturaleza jurídica en el procedimiento administrativo, y como su aplicación irrestricta puede afectar derechos de los administrados vigentes en normas de rango legal y constitucional.
Sin perjuicio de la naturaleza de petición de gracia, las iniciativas privadas son procedimientos administrativos y por tanto son aplicables la Ley de Procedimiento Administrativo General, la Constitución y las normas que rigen la función pública, éstas garantizan el interés público, los derechos del proponente, limitan las prerrogativas públicas y evitan que la discrecionalidad de las decisiones administrativas se convierta en arbitrariedad lo que resulta contraproducente a la promoción de la inversión privada. En este sentido se analizan los diversos tipos de control aplicables a las actuaciones administrativas que son parte de este procedimiento, que en el caso de contener elementos discrecionales adquieren una particular importancia e intensidad.
Private Initiatives (Unsolicited Proposal) are mechanisms to promote private investment that the government impulse as a development tool, within the economic constitutional model "Social Market Economy", therefore, administrative decisions must be oriented to foster and create incentives for the presentation of projects proposals in this way. This research studies the administrative procedures of Private Initiatives assessment and the role of public administration. Private initiatives are usually qualified as grace petitions (applications for clemency) because of the discretionary factors included in the administrative decision that qualify them,, accordingly the implications and scope of this legal status in the administrative procedure are analyzed, in addition how the unrestricted application of this may affect rights of private in current legal and constitutional rules. Notwithstanding the nature of grace petition, private initiatives are administrative procedures and therefore are applicable the General Administrative Procedure Act, the Constitution and the rules of civil service, they guarantee the public interest, the proponents rights, limit public prerogatives and prevent the discretionary power of public administration becomes in arbitrarily, it produce adverse effects to the private investment promotion. In this regard the various types of control applicable to administrative behavior that are part of this procedure are studied, in the case contain discretionary elements acquire particular importance and intensity.
