Resumen
El objetivo del presente informe jurídico consiste en llevar a cabo un análisis
crítico de la Resolución N° 152-2018-OEFA/TFA-SMEPIM en el marco del caso
Compañía Minera Colquirrumi S.A. vs Organismo de Evaluación y Fiscalización
Ambiental (OEFA). Es así que, mediante la interpretación de la normativa
peruana general y sectorial así como de la búsqueda de información obtenida de
la jurisprudencia y de distintas fuentes académicas; el análisis realizado nos
proporcionará una comprensión detallada de los fundamentos jurídicos que rigen
los temas vinculados a los límites máximos permisibles (LMP), la responsabilidad
solidaria en el marco de contratos de transferencia de pasivos ambientales
mineros y su procedimiento, medidas correctivas, e incluso la incorporación de
terceros al procedimiento administrativo sancionador.
A partir del análisis efectuado, podremos llegar a la conclusión de que
Colquirrumi es responsable administrativamente por haber cometido las
conductas infractoras correspondientes al incumplimiento de los LMP para
efluentes minero-metalúrgicos, así como del Plan de Cierre de Pasivos
Ambientales Mineros aprobado por el MINEM en su momento. Asimismo, no
corresponde liberar a la minera de la responsabilidad solidaria que mantiene
junto con CIEMAM debido al contrato celebrado entre las partes que transfiere
la posesión y/o propiedad de los PAM. Por último, los argumentos presentados
por Colquirrumi carecen de sustento para demostrar la inviabilidad de cumplir
con la medida correctiva impuesta por OEFA dado que no se han presentado
pruebas suficientes que indiquen la existencia de acciones destinadas a
obstaculizar la ejecución de las medidas de remediación ambiental.
The objective of this legal report consists of carrying out a critic analysis of the Resolution N° 152-2018-OEFA/TFA-SMEPIM within the framework of the case Compañía Minera Colquirrumi vs Organismo de Evaluación y Fiscalización Ambiental (OEFA). Thus, it is through the interpretation of general and sectorial Peruvian regulations as well as the search for information obtained from jurisprudence and different academic sources, that the analysis will provide us with a detailed understanding of the legal basis that governs the issues related to the maximum permissible limits (MPL), joint liability in the framework of contracts for the transfer of mining environmental passives and its procedure, corrective measures, and even the incorporation of third parties to the administrative sanctioning procedure. From the analysis carried out, we can conclude that Colquirrumi is administratively responsible for having committed the infringing conducts corresponding to the non-compliance with the MPL for mining-metallurgical effluents, as well as with the mining environmental passives closure plan approved by MINEM at the time. Likewise, it is not appropriate to release the mining company from the joint liability it has with CIEMAM due to the contract signed between the parties that transfers the possession and/or ownership of the mining environmental passives. Finally, the arguments presented by Colquirrumi lack support to demonstrate the unfeasibility of complying with the corrective measure imposed by OEFA given that sufficient evidence has not been presented to indicate the existence of actions aimed at obstructing the execution of the environmental remediation measures.
