Resumen
El presente informe jurídico analiza el pronunciamiento emitido por la Sala
Especializada en Defensa de la Competencia del INDECOPI mediante la
Resolución 0858-2013/SDC-INDECOPI, donde se pronuncia sobre la denuncia
interpuesta por Industrias Willy Busch S.A. contra Filtros LYS S.A. por la presunta
comisión de infracciones al Decreto Legislativo 1044, Ley de Represión de la
Competencia Desleal. Concretamente, por el despliegue de una estrategia de
abuso de procesos legales, así como la emisión de una serie de anuncios
publicitarios dirigidos a denigrar o compararse indebidamente con la
denunciante. El objetivo principal de este informe es determinar si la
interpretación que el órgano colegiado de segunda instancia hace de la
aplicación de la cláusula general, es congruente con la naturaleza de las normas
de represión de la competencia desleal y, a su vez, compatible con lo establecido
en las normas de libre competencia, que también recogen esta conducta bajo la
prohibición relativa. Para esto, se analizarán los principales problemas jurídicos
detectados en el caso, para luego contrastar la forma en que la Sala decidió
sobre el particular recurriendo a la jurisprudencia pertinente en la materia, así
como a la posición de la doctrina nacional e internacional. Este trabajo se justifica
en la complejidad de la imputación principal del caso y la trascendencia de la
decisión, dado que esta definió la forma de compatibilizar los regímenes de
defensa de la competencia y represión de la competencia desleal al momento de
postular una conducta de abuso de procesos legales
This legal report analyzes the decission issued by the Specialized Chamber for the Defense of Competition of INDECOPI through Resolution 0858-2013/SDC INDECOPI, where it rules on the complaint filed against Filtros LYS S.A. by Industrias Willy Busch S.A. for the alleged commission of violations under the Legislative Decree 1044, Peruvian Unfair Competition Law. Specifically, for the deployment of a sham litigation strategy, as well as the issuance of a series of advertisements aimed at denigrating or unduly comparing itself with the complainant. The main objective of this report is to determine whether the interpretation that the administrative court makes of the application of the general clause is consistent with the nature of the rules of unfair competition law and, in addition, compatible with the provisions of the antitrust laws, which also prohibits this conduct under the relative prohibition rule. For this purpose, the main legal problems detected in the case will be analyzed, to then contrast the way in which the Chamber decided on the issue by resorting to the relevant jurisprudence on the matter, as well as the position of the national and international doctrine. This work is justified by the complexity of the main charge of the case and the relevance of the decision, since it defined the way in which the antitrust and unfair competition laws should be made compatible when dealing with a case of abuse of legal process.
