Resumen
En el presente trabajo se analiza, no solo desde una perspectiva de derecho del
consumidor, sino desde los derechos humanos y de derecho constitucional, algunos
aspectos de la Resolución N° 2025-2019/SPC-INDECOPI. Se pregunta si es que, en la
situación suscitada en la referida Resolución, efectivamente hubo discriminación por
razones etarias a personas mayores de edad. Para ello primero elabora un breve marco
teórico sobre el derecho a la igualdad y no discriminación en el que se repasan diversos
instrumentos internacionales que recogen y profundizan en estos derechos
fundamentales, a la luz del Derecho Internacional de los Derechos Humanos. En
segundo lugar, se enfoca en el análisis de los derechos fundamentales de las personas
mayores, como es el derecho a una vivienda digna, basándose también en instrumentos
internacionales que los han desarrollado. Se realiza una mención especial a la
Convención Interamericana sobre los Derechos Humanos de las Personas Mayores,
único instrumento internacional de obligatorio cumplimiento, recientemente ratificado
por nuestro país. Luego, se explora la función de las instituciones financieras y su
colaboración con el Estado, especialmente a través del Fondo Mivivienda, en el
desarrollo de alternativas que permitan a las personas mayores el pleno goce de sus
derechos. Posteriormente, se comenta el impacto económico y de costos que podría
tener para las instituciones financieras el otorgamiento de créditos a personas mayores,
desde una perspectiva de su responsabilidad empresarial para con los derechos
humanos. Finalmente, se realiza un test de proporcionalidad con la finalidad de verificar
y validar la constitucionalidad de las medidas propuestas en el Informe.
In this paper, the author analyzes, from human rights and constitutional law perspective some aspects of the Resolution N° 2025-2019/SPC-INDECOPI. He wonders if in the mentioned situation, older consumers were discriminated based on their age. First, he elaborates a short theoretical framework about the right to be treated equally and to not be discriminated by any reason, in which he reviews a series of international instruments that provide a development of these fundamental rights, based on International Human Rights Law. Second, the author focuses on the analysis of older consumers human and fundamental rights, such as owning a deserving house, based on the international instruments that have developed these topics. He does a special mention to the Inter-American Convention on Protecting the Human Rights of Older Persons, the only instrument of mandatory compliance, that has been recently ratified by our country. Then, he analyses the function of financial institutions and their collaborative work with the government, especially with Fondo Mivivienda, in the development of alternatives that allow older consumers to pursue their fundamental and human rights. Finally, we elaborate a proportionality test in order to validate the constitutionality of the proposed measures in this paper.
