Abstract
La sentencia recaída en el Expediente No. 02748-2021-PA/TC, caso Meléndez Vega,
ha introducido un nuevo paradigma en la interpretación de la protección reforzada de
las trabajadoras gestantes. Esta interpretación de la tutela reforzada se ha visto reflejada
en el apartamiento de los criterios de primacía de los principios del empleo público,
establecidos en la sentencia del caso Huatuco Huatuco; y en la generación de riesgos
interpretativos sobre la obligación de notificar el estado de gestación al empleador, dado
que tal situación conduce a la ausencia de criterios para la protección de la salud de la
trabajadora gestante y parámetros para la determinación de un embarazo notorio.
Además, la sentencia resulta disruptiva en la tendencia resolutiva de los amparos
laborales, al ordenar una reposición provisional que aparenta observar a futuro los
principios de meritocracia y provisión presupuestal.
The resolution of the Case No. 02748-2021-PA/TC, Meléndez Vega, has introduced a new paradigm in the interpretation of enhanced protection for pregnant workers. This interpretation of enhanced guardianship is evidenced by departing from the primacy criteria of public employment principles established in the Huatuco Huatuco case, and by generating interpretative risks regarding the obligation to notify the employer of pregnancy status, given that such a situation leads to a lack of criteria for the protection of the pregnant worker's health and parameters for determining conspicuous pregnancy. Furthermore, the judgment disrupts the customary resolution trend in labor amparos by ordering provisional reinstatement that ostensibly anticipates adherence to meritocracy and budgetary provision principles, along with restitution of withheld wages.
