Resumen
El Estado peruano reconoce la gravedad y la problemática que representa el
delito de trata de personas. Siendo el fin supremo y último del Estado, la defensa
de la persona humana y de su dignidad1. No obstante, la Corte Suprema de
Justicia de la República en Recurso de Nulidad N° 2349-2014 decide,
contradictoriamente a los medios de prueba aceptados, absolver a la persona
denunciada. Cabe detallar que el Recurso de Nulidad N° 2349-2014 versa sobre
la captación, traslado, retención y posterior explotación laboral que realizó la
señora Elsa Cjuno Huillca en agravio de la niña de iniciales D.R.Q.R. durante el
02 de enero de 2008 al 27 de enero de 2008. Esto, con la finalidad de que la
citada se desempeñe como dama de compañía en el bar de su propiedad. Dicha
situación conlleva a cuestionarse si la decisión de los jueces supremos responde
al marco jurídico establecido por el Estado peruano en la lucha contra la trata de
personas. Así mismo, en concordancia con el principio de “buen gobierno”,
entendido como el adecuado y responsable ejercicio del poder y del
cumplimiento de función estatal, garantizando la realización de los derechos
humanos y la protección del interés general2, corresponde cuestionar la
actuación judicial.
The Peruvian state acknowledges the seriousness and the problematic nature of human trafficking. The supreme and ultimate goal of the State is the defense of the human person and their dignity. However, in Appeal of Nullity No. 2349-2014, the Supreme Court of Justice of the Republic decides, contradictorily to the accepted evidence, to acquit the accused person. It is important to note that Appeal of Nullity No. 2349-2014 concerns the recruitment, transportation, retention, and subsequent labor exploitation carried out by Mrs. Elsa Cjuno Huillca against the minor identified by initials D.R.Q.R. from January 2, 2008, to January 27, 2008. This was done with the purpose of the minor working as a companion in her own bar. This situation leads to questioning whether the decision of the supreme judges aligns with the legal framework established by the Peruvian state in combating human trafficking. Furthermore, in accordance with the principle of "good governance," understood as the appropriate and responsible exercise of power and the fulfillment of state function, ensuring the realization of human rights and the protection of the public interest, it is appropriate to question the judicial actions.
