Resumen
La Resolución Nº 2025-2019/SPC-INDECOPI, emitida por la Sala Especializada
de Protección al Consumidor, consiste en un caso de discriminación en el
consumo, iniciado de oficio, en contra del Banco Interamericano de Finanzas.
Esto, debido a que la entidad bancaria denunciada habría infringido el artículo
38 de la Ley Nº 29571, al establecer como requisito para el otorgamiento de
créditos como El Nuevo Crédito MiVivienda y Crédito Hipotecario encontrarse
dentro de cierto rango etario. En ese sentido, la resolución es de relevante
importancia debido a que, no solo se analiza un criterio que afectaría a una
población en situación de vulnerabilidad, sino también porque presenta un
cambio de criterio en cuanto a la interpretación de discriminación en el consumo.
Tomando en consideración ello, el presente informe jurídico se dividirá en tres
apartados. En un primer momento, se tratará de determinar si el Banco actuó de
forma discriminatoria al establecer como requisito para acceder a dos de sus
productos, encontrarse dentro de un rango etario. En un segundo momento, se
buscará analizar si el criterio etario puede ser considerado como un requisito
razonable y objetivo, para evaluar si se debe otorgar un crédito o no a la persona
quien lo solicita. Finalmente, se realizará un análisis sobre la los criterios
utilizados por la Comisión, que fueron confirmados por la Sala, para imponer la
multa por la infracción del artículo 38 del Código de Protección y Defensa del
Consumidor.
Resolution 2025-2019/SPC-INDECOPI, issued by the Specialized Chamber for Consumer Protection, consists of a case of discrimination in consumption, initiated ex officio, against the Inter-American Bank of Finance. This, because the bank denounced would have violated article 38 of Law Nº 29571, by establishing as a requirement for the granting of credits such as Nuevo Crédito MiVivienda and Crédito Hipotecario be within a certain age range. In this sense, the resolution is of importance because it not only analyzes a criterion that would affect a population in a situation of vulnerability, but also because it presents a change in the interpretation of discrimination in consumption. Taking this into account, this paper will be divided into three sections. In the first instance, it will be a question of whether the Bank acted in a discriminatory manner by making two of its products subjects to eligibility within an age range. In a second stage, it will be sought to analyze whether the age criterion can be considered as a reasonable and objective requirement, to assess whether a credit should be granted or not to the person requesting it. Finally, an analysis will be made of the criteria used by the Commission, which were confirmed by the Chamber, to impose the fine for the infringement of Article 38 of the Consumer Protection and Defense Code.
