Resumen
La política pública de fomento de instalación de infraestructura de telecomunicaciones,
materializada a través de lo dispuesto por la Ley N° 29022, Ley para la Expansión de
Infraestructura en Telecomunicaciones, y sus modificaciones, obedece a una creciente
demanda de la sociedad actual de recibir tales servicios por parte de los operadores de
telefonía.
No obstante, en la realidad puede observarse cómo las Municipalidades, amparándose
en su autonomía conferida a nivel constitucional y legal, realizan determinadas
actuaciones que obstaculizan la operatividad de dichas infraestructuras, sin sustento
normativo que las justifiquen, contraviniendo así lo dispuesto por la Ley N° 29022,
siendo esta última norma la única exigible en materia de acceso al mercado en este
sector.
En el caso en concreto, se aprecia que la Municipalidad Distrital de San Borja prohíbe
la instalación de infraestructura de telecomunicaciones, así como también impone una
serie de condiciones para su puesta en funcionamiento a la empresa Torres Unidas
SRL, a través del Oficio N° 301-2019 y Acta de Paralización N° 062-2019.
Bajo tales premisas, el presente informe tiene como objetivo principal determinar que en
tal supuesto en el que la Municipalidad impide y condiciona la instalación de un poste a
la empresa, hay una indebida interpretación, de parte de la entidad, de lo que implica la
autonomía, tomando en consideración de que esta es una potestad con límites
demarcados tanto a nivel legal como jurisprudencial. Siendo, a su vez, estas conductas,
materializadas a través de actos administrativos, constitutivas de barreras burocráticas
ilegales.
The public policy of promoting the installation of telecommunications infrastructure, materialized through the provisions of Law No. 29022, Law for the Expansion of Telecommunications Infrastructure, and its modifications, obeys a growing demand from today's society to receive such services by telephone operators. However, in reality it can be observed how the Municipalities, relying on their autonomy conferred at the constitutional and legal level, carry out certain actions that hinder the operation of said infrastructures, without normative support that justifies them, thus contravening the provisions of Law No. 29022, this last standard being the only one required in terms of market access in this sector. In the specific case, it is appreciated that the District Municipality of San Borja prohibits the installation of telecommunications infrastructure, as well as imposes a series of conditions for its commissioning to the company Torres Unidas SRL, through Official Letter No. 301 -2019 and Stoppage Act No. 062-2019. Under such premises, the main objective of this report is to determine that in such a case in which the Municipality prevents and conditions the installation of a pole to the company, there is an improper interpretation, on the part of the entity, of what autonomy implies, taking into consideration that this is a power with demarcated limits both legally and jurisprudentially. Being, in turn, these behaviors, materialized through administrative acts, constituting illegal bureaucratic barriers.
