Resumen
El presente informe abarca el análisis de la procedencia de una ampliación de plazo
evaluando el requisito de necesidad proscrito por la misma norma. Asimismo, se analiza
el procedimiento en sí mismo de los adicionales de obra, sobre todo aquellos que
superan el 15% de monto del contrato. En ese sentido, se repasa una serie de elementos
y sujetos que interfieren en este procedimiento para finalmente llegar a la conclusión de
si es que podría recaer en el contratista la responsabilidad por aquellos plazos
consumidos al momento de aprobar el adicional.
De este modo, concluiremos señalando como es que el contratista no puede ni debería
soportar aquellas consecuencias negativas que se le puedan ocasionar por el
procedimiento de la aprobación de adicionales, aun cuando sean plazos legales
previstos y conocidos por ambas partes. No obstante, se precisará en el informe que
esta conclusión no es irrestricta, en tanto solo podremos acceder a ella cuando la
afectación en el plazo sea acreditada a través de la afectación en la ruta crítica y la
evaluación del resto de requisitos de toda ampliación de plazo.
Cabe señalar que, en el presente informe también se abarcan aspectos como la
intervención de la Contraloría General de la República en este tipo de procedimientos,
y cómo su decisión puede terminar en un proceso contencioso administrativo.
This report covers the analysis of the appropriateness of a term extension by evaluating the requirement of necessity proscribed by the same rule. It also analyzes the procedure itself of the additional works, especially those that exceed 15% of the amount of the contract. In this sense, a series of elements and subjects that interfere in this procedure are reviewed in order to finally reach the conclusion as to whether the contractor could be held responsible for those deadlines consumed at the time of approving the additional work. In this way, we will conclude by pointing out that the contractor cannot and should not bear those negative consequences that may be caused by the procedure for the approval of additional services, even though they are legal deadlines foreseen and known by both parties. However, it will be specified in the report that this conclusion is not unrestricted, since we can only agree to it when the impact on the deadline is accredited through the impact on the critical path and the evaluation of the rest of the requirements of any extension of the deadline. It should be noted that this report also covers aspects such as the intervention of the Office of the Comptroller General of the Republic in this type of procedure, and how its decision may end up in an administrative litigation process
