Resumen
Reglamento del Procedimiento Administrativo Sancionador Especial de
Tramitación Sumaria, realizado por la Superintendencia de Transporte Terrestre
de Personas, Carga y Mercancías (SUTRAN), y los resultados obtenidos desde
su implementación hasta la actualidad, tomando en cuenta los objetivos
planteados en la exposición de motivos, vinculado por ejemplo a determinar si
el índice de siniestralidad ha disminuido, si se ha recortado la carga procesal, si
la institución ha logrado resolver oportunamente o, específicamente, si la
prestación del servicio de transporte de vehículos sin autorización se ha
reducido, etc.
La novedad de su implementación no permite hacer un balance de mayor
calado, pero de manera preliminar se resalta que es relativamente positivo,
básicamente, respecto a la reducción de la carga procesal de la institución; sin
embargo, no hay mayor relevancia en relación al desincentivo de infracciones,
por lo que el nivel de satisfacción derivado de este aspecto es bajo.
En ese sentido, de la experiencia del cambio del procedimiento administrativo
sancionador ordinario a uno sumario, se advierte la importancia de tomar en
cuenta criterios como el costo de oportunidad o la probabilidad de detección,
para la elaboración de normativas vinculadas al transporte, dado la poca
sistematicidad institucional que hace la tarea compleja para la Administración.
In the present research work, the application of the New Regulation of the Special Administrative Sanctioning Procedure of Summary Processing, carried out by the Superintendency of Land Transport of People, Cargo and Goods (SUTRAN), and the results obtained from its implementation to the present, are analyzed. taking into account the objectives set out in the explanatory memorandum, linked, for example, to determining whether the accident rate has decreased, whether the procedural burden has been reduced, whether the institution has managed to resolve in a timely manner or, specifically, whether the provision of the transportation of unauthorized vehicles has been reduced, etc. The novelty of its implementation does not allow for a more profound assessment, but in a preliminary way it is highlighted that it is relatively positive, basically, with respect to the reduction of the procedural burden of the institution; however, there is no greater relevance in relation to the disincentive for infringements, so the level of satisfaction derived from this aspect is low. In this sense, from the experience of the change from the ordinary penalizing administrative procedure to a summary one, the importance of taking into account criteria such as the opportunity cost or the probability of detection is noted, for the elaboration of regulations related to transport, given the little institutional systematicity that makes the task complex for the Administration.
