Resumen
En Perú, los empleadores que realizan actividades que implican cierto riesgo
se encuentran obligados a contratar un seguro especial que es el Seguro
Complementario de Trabajo de Riesgo a través del cual se brinda cobertura en
salud y pensiones a los trabajadores a raíz de un accidente de trabajo o una
enfermedad ocupacional.
El presente informe tiene como principal objetivo analizar el criterio de la Corte
Suprema comprendido en la Casación Laboral 1278-2018 AREQUIPA respecto
de la solicitud de reconocimiento judicial de una pensión por invalidez por
enfermedad ocupacional en virtud del Seguro Complementario de Trabajo de
Riesgo por parte de un trabajador minero.
Para esos efectos; en primer lugar, se describirán los hechos y documentos
que sustentan la solicitud a nivel judicial. En segundo lugar, se expondrán los
pronunciamientos de las distintas instancias judiciales, incluyendo la de la
Corte Suprema, para así detallar los principales problemas jurídicos que se
desprenden del caso.
En tercer lugar, se analizará cada uno de los problemas jurídicos en torno las
posturas asumidas por las instancias judiciales para así justificar la postura
asumida de la autora sobre cada uno de ellos.
Finalmente, se establecerán las conclusiones y las recomendaciones de la
autora para contribuir en la mejor comprensión y aplicación de la legislación
que regula la pensión por invalidez.
In Peru, employers who perform activities that involve certain risk are obliged to contract a special insurance which is the Complementary Risk Work Insurance through which health and pension coverage is provided to workers as a result of a work accident or occupational disease. The main purpose of this report is analyze the criteria of the Supreme Court included in the Labor Cassation 1278-2018 AREQUIPA regarding the request for judicial recognition of a disability pension due to occupational disease by virtue of the Complementary Risk Work Insurance by a mining worker. For such purposes; firstly, the facts and documents supporting the request at the judicial level will be described. Secondly, the pronouncements of the different judicial instances, including that of the Supreme Court, will be presented in order to detail the main legal problems arising from the case. Thirdly, each of the legal problems will be analyzed in relation to the positions taken by the judicial instances in order to justify the position taken by the author on each of them. Finally, the author's conclusions and recommendations will be established to contribute to a better understanding and application of the legislation that regulates the disability pension.
