Abstract
La presente investigación analiza las implicancias de las normas sobre Transparencia de
la Información emitidas por la Superintendencia de Banca y Seguros, con la finalidad de
reducir la asimetría informativa de los consumidores al adoptar decisiones de consumo
sobre los productos financieros que ofrecen los bancos. La protección a los usuarios
financieros es necesaria debido a que ellos tienen un menor conocimiento de los
productos y servicios financieros de las empresas del sistema financiero, pero el
mecanismo propuesto por la Ley de Transparencia, de brindar a los usuarios
información, no resulta necesariamente en una efectiva protección debido a que el
exceso de información que les brindan los bancos por exigencia de la Superintendencia
de Banca y Seguros no corresponde a la real necesidad de información que los
consumidores requieren, y no necesariamente constituye información relevante para
tomar una decisión de consumo adecuada. En conclusión, una mayor protección al
usuario financiero en realidad equivale a una menor protección para él.
Los consumidores financieros no sofisticados requieren protección y herramientas para
tomar conocimiento de las condiciones aplicables a los productos financieros, pero estas
herramientas no pueden abrumar al usuario, sino que deben facilitarle la vida, por lo que
la data que se le debe entregar debe ser únicamente la necesaria y suficiente para
conocer las principales condiciones que lo conduzcan a una adecuada decisión de
consumo.
The present investigation analyzes the implications of the rules on Transparency of Information issued by the Superintendency of Banking and Insurance, with the purpose of reducing the informational asymmetry of the consumers when adopting consumption decisions on the financial products offered by the banks. The protection of financial users is necessary because they have less knowledge of the financial products and services of financial system companies, but the mechanism proposed by the Transparency Law, to provide users with information, does not necessarily result in an effective protection because the excess of information provided by banks as required by the Superintendency of Banking and Insurance does not correspond to the real need for information that consumers require, and does not necessarily constitute relevant information to make an adequate consumption decision . In conclusion, greater protection for the financial user is actually equivalent to less protection for him. Unsophisticated financial consumers require protection and tools to become aware of the conditions applicable to financial products, but these tools can not overwhelm the user, but should make life easier for them, so the data that should be delivered should be only the necessary and sufficient to know the main conditions that lead to an adequate consumption decision.
